Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-02-035 <br /> <br /> WHEREAS, F & R Enterprises, a Minnesota Partnership, has applied to the City <br />for a Minnesota Pollution Control Agency ("MPCA") open burning permit; and <br /> <br /> WHEREAS, the open burning permit request is for permission to conduct <br />opening burning on that property legally described as follows: <br /> <br />The Northeast Quarter of the Northwest Quarter of Section 29, <br />Township 32, except the right-of-way line of the Burlington <br />Northern Railway, County of Anoka, State of Minnesota; <br /> <br />(the "Site"); and <br /> <br /> WIIEREAS, the purpose of the burning is to burn a substantial number of fallen <br />pine trees on the site which are damaged and dead; and <br /> <br /> WHEREAS, the damage to the trees occurred as a result of a fire in April 1988, <br />allegedly caused by a passing train; and <br /> <br /> WHEREAS, the City previously denied an open burning permit to F & R in July <br />1989 based on then extremely dry conditions at the site including possible smoke nuisance <br />and fire hazard to adjacent properties; and <br /> <br /> WHEREAS, F & R proposes to burn only during periods when the adjacent <br />ground cover is moisture saturated; and <br /> <br /> WHEREAS, the City's Fire Chief is of the opinion that the snow cover provision <br />will substantially decrease the fire hazard from the burning site and surrounding properties; <br />and <br /> <br /> WIIEREAS, the City has the authority to issue open burning permits conditioned <br />upon compliance with MPCA rules and regulations; and <br /> <br /> WHEREAS, the City requ/res that the open burning be in compliance with MPCA <br />rules and regulations relating to air quality and air emissions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />That the City Council hereby grants an open burning permit to F & R Enterprises, a <br />Minnesota Partnership, upon the following conditions: <br /> <br />1) <br /> <br />Those nine (9) conditions as contained on MPCA "Application for Permit for Open <br />Burning", a copy of which application is attached hereto and incorporated herein. <br /> <br />2) The burning permit is issued for that property legally described as follows: <br /> <br />The Northeast Quarter of the Northwest Quarter of Section 29, <br />Township 32, except the right-of-way line of the Burlington <br />Northern Railway, County of Anoka, State of Minnesota. <br /> <br />Resolution #92-02-035 <br /> Page 1 of 3 <br /> <br /> <br />
