Commissioner Deemer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-03-054 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT g0308 RELATING TO <br />DENNIS HARPER'S REQUEST FOR A VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN <br /> THE PRINCIPAL STRUCTURE ON LOT 5, BLOCK 1, <br /> BOWERS MISSISSIPPI ACRES 2ND ADDITION <br /> <br />That Mr. Dennis E. Harper, Sr., hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey City Code <br />to construct an accessory structure nearer the front property line than the principal structure <br />on the property generally known as 14390 Bowers Drive N.W. and legally described as <br />follows: <br /> <br />Lot 5, Block 1, Bowers Mississippi Acres 2nd Addition, Anoka County, Minnesota <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on March 26, 1992, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />o <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately one (1) acre <br />in size. <br /> <br />4. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />o <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That Chapter 9.21 of the Ramsey City Code establishes a structure setback of 200 feet from <br />the Mississippi River. <br /> <br />That the principal structure on the property is located approximately 158 feet from the front <br />property line and 175 feet from the Mississippi River. <br /> <br />o <br /> <br />That the Applicant is proposing to construct a 26' x 24' accessory structure on the <br />property. <br /> <br />o <br /> <br />That there is not a sufficient amount of width in the side yards to accommodate the structure <br />and required side yard setbacks. <br /> <br />10. <br /> <br />That if the accessory structure were to be constructed in the rear yard, it would encroach on <br />the 200 foot setback from the Mississippi River. <br /> <br />11. <br /> <br />That similar variances have been granted in the R-1 Rural Residential District generally and <br />in various additions of Bowers Mississippi Acres specifically. <br /> <br />12. That the request is not a use variance. <br /> <br />13. <br /> <br />That if granted, the proposed variance will not impair an adequate supply of light and air to <br />adjacent property. <br /> <br /> <br />
