14. <br /> <br />That if granted, the proposed variance will not unreasonably increase thc congestion in thc <br />public street. <br /> <br />15. <br /> <br />That if granted, the proposed variance will not adversely impact the degree of public health, <br />safety and general welfare provided for in the Ramsey City Code. <br /> <br />16. <br /> <br />That if granted, the proposed variance will not unreasonably diminish established property <br />values within the neighborhood. <br /> <br />17. <br /> <br />That the Mississippi River setback requirement imposes a hardship on the subject property <br />that is not applicable to other lands in the same district and that the variance is necessary for <br />the preservation of a substantial property right similar to that possessed by other properties <br />in the R-1 Rural Residential District. <br /> <br />18. <br /> <br />That the unique circumstances on the subject property do not result from the actions of the <br />Applicant. <br /> <br />19. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of land in the same district. <br /> <br />20. <br /> <br />That the request for the variance is not a result of nonconforming lands, structures or <br />buildings in the same district. <br /> <br />21. <br /> <br />That the variance requested is the minimum variance necessary to accomplish the intended <br />purpose of the Applicant.. <br /> <br />22. <br /> <br />That the only other site on the property that would accommodate the proposed accessory <br />structure should be preserved as a future site for a replacement drainfield in the event the <br />existing drainfield fails. <br /> <br />23. <br /> <br />That the property owner of Lot 4, Block 1, Bowers Mississippi Acres 2nd Addition, was <br />present at the public hearing and also provided the Board of Adjustment with a written <br />statement, dated received by the City on March 20, 1992 and hereby incorporated by <br />reference, noting adamant opposition to the Applicanfs proposed location for the accessory <br />structure. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Bawden and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Terry Hendriksen <br />Commissioner Charles LaDue <br />Commissioner Ben Deemer <br />Commissioner David Bawden <br />Commissioner Michael Terry <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />Commissioner Paul Holland <br /> <br /> <br />
