Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-05-I06 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT /10311 RELATING TO <br />A REQUEST BY FRED DINNETZ FOR A CONDITIONAL USE PERMIT FOR <br /> MOTOR VEHICLE REPAIR/TOWING SERVICE/NEW PARTS SALES AT <br /> 14600 NOWTHEN BLVD. N.W. (PIN 25-32-25-23-0006) <br /> <br />o <br /> <br />o <br /> <br />o <br /> <br />That Fred Dinnetz, hereinafter referred to as "Applicant", has properly applied for a <br />conditional use permit to operate an auto repair/towing service/new parts sales facility in the <br />R-3 Urban Residential District. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />heating pursuant to Section 9.03.04 of the Ramsey City Code on April 6, 1992 and that the <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the subject property is generally known as 14600 Nowthen Blvd. N.W. and is legally <br />described as follows: <br /> <br />That part of the Southwest Quarter of the Northwest Quarter of Section 25, Township 32, <br />Range 25, Anoka County, Minnesota, described as follows: Commencing at the West <br />Quarter corner of said Section 25, thence North 90 degrees 00 minutes East, along the <br />South line of said Northwest Quarter, a distance of 829.6 feet; thence North 30 degrees 49 <br />minutes 30 seconds West, a distance of 401.96 feet; thence North 29 degrees 55 minutes <br />10 seconds West, a distance of 288.37 feet; thence North 60 degrees 04 minutes 50 <br />seconds East, a distance of 247.03 feet, more or less, to the centerline of County State Aid <br />Highway No. 5; thence South 29 degrees, 55 minutes 10 seconds East, along the <br />Centerline of said Highway No. 5, a distance of 416.97 feet; thence South 87 degrees 34 <br />minutes 50 seconds West, a distance of 278.5 feet, more or less, to the point of beginning. <br />Subject to an easement for roadway purposes over the Northwesterly 33 feet thereof and to <br />said State Aid Highway No. 5. <br /> <br />That the subject property is approximately two (2) acres in size. <br /> <br />That the subject property is zoned R-3 Urban Residential for which motor vehicle repair, <br />towing services, and auto parts sales are not permitted uses. <br /> <br />That the adjacent parcels to the south are zoned R-3 Urban Residential, the parcels to the <br />west, north and the property across Nowthen Blvd. to the east are zoned R-1 Urban <br />Residential. <br /> <br />That the City has previously issued conditional use permits for motor vehicle repair <br />facilities in the residential district. <br /> <br />That the Applicant has submitted a Boundary and Topographic Survey dated May 5, 1979 <br />with a site plan added on March 16, 1992, prepared by Keith M. Graham, Land Surveyor. <br />The site plan proposes a 20'x45' addition to the existing 1,500 square foot structure for <br />cold storage purposes; an opaque fenced tire storage area; a dumpster enclosure; a blacktop <br />driveway and off-street parking area; and an opaque fenced impound lot. <br /> <br /> <br />
