That the Applicant has also submitted a site plan for future expansion of the site whereby the existing building would be enlarged to accommodate new auto pans sales in the existing structure and auto repair would be carried on in the building expansion; the cold storage area and impound lot would also be expanded. That on December 17, 1985, a conditional use permit was issued to the subject property under the name of Gerald Root for auto sales and repair. Said conditional use permit was revoked on January 28, 1992, for non-compliance. That the proposed use will not adversely impact traffic in the area. That the proposed use will not be dangerous or detrimental to persons residing or working in the vicinity of the proposed use. That the proposed use will substantially or adversely impair the use, enjoyment or market value of surrounding properties. That the proposed use will not be harmonious with and in accordance with the specific objectives of the Comprehensive Plan. That the proposed use will not be operated and maintained in order to be harmonious and appropriate in appearance with the existing and intended character of the R-3 Urban Residential District and the proposed use will change the essential character of the R-3 Urban Residential District. , That the proposed use will be disturbing to existing or future neighboring land uses. That the proposed use will not be an improvement to the property in the immediate vicinity and to the community as a whole. That the proposed use will be adequately served by essential public services and facilities. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and that the proposed use will be detrimental to persons, property or the general welfare. That at the public hearing, the Applicant amended his request to a temporary conditional use permit not to exceed 18 months. That at the public heating, the Applicant indicated that if a temporary conditional use use permit is granted, he would not construct improvements to the property and accordingly would withdraw the site plan dated March 16, 1992. That the Applicant has indicated that the decision to amend the request to a temporary conditional use permit is in response to City Staff concerns with the compatibility of an auto repair facility in a residentially zoned area. That the Applicant has indicated that he has entered into a purchase agreement for the subject property, which is hereby incorporated as a pan of these findings by reference. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beyer and upon vote being taken thereon, the following voted in favor thereof:
