Commissioner Deemer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-07-175 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0317 RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT ACCESSORY STRUCTURES <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />ON THE PROPERTY GENERALLY KNOWN 8301 163RD AVENUE N.W. <br /> <br />o <br /> <br />o <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />That Mr. Daniel Brehm, hereinafter referred to as "Applicant", has properly applied for a <br />Board of Adjustment variance from Section 9.11.02 of the Ramsey City Code to construct <br />an accessory garage and a storage building nearer the front property line than the principal <br />structure on the property generally known as 8301 163rd Avenue N.W. and legally <br />described as follows: <br /> <br />Lot 6, Block 4, Oakridge Estates, Anoka County, Minnesota <br /> <br />That the Applicant appeared before the Board of Adjustment for a public heating pursuant <br />to Section 9.03.05 of the Ramsey City Code on July 23, 1992 and that said public heating <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the subject property is zoned R-i Rural Residential and is approximately 2.5 acres in <br />size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />'12mt the principal structure on the subject property is located approximately 250 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 100 feet <br />from the front property line and a mini-storage building approximately 190 feet from the <br />front property line. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the developer of the lot has created a <br />250 foot front yard setback by the placement of the home; that the side and rear yards of the <br />subject property are not acceptable locations for accessory structures due to sharp declines <br />in topography, trees, wetlands, septic system location and wetlands. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant as the home was platted and constructed on the property by persons other than <br />the Applicant. <br /> <br />That the Applicant has submitted a petition signed by five (5) area residents stating no <br />objection to the Applicants proposal for construction of an accessory garage and storage <br />building. <br /> <br />That similar variances have been granted in the R- 1 Rural Residential district in the City of <br />Ramsey. <br /> <br /> <br />
