Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> RESOLUTION #92-09-245 <br /> <br /> RESOLUTION ADOPTING FINDINGS OF FACT #0321 RELATING TO A <br /> REQUEST FOR A CONDITIONAL USE PERMIT FOR AN OUTDOOR DISPLAY <br /> AREA IN THE B-3 BUSINESS DISTRICT <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, <br />ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Mr. Thomas Kurak, hereinafter referred to as the "Applicant", properly applied for a <br />conditional use permit to have an outdoor display area associated with a motor vehicle sales <br />lot. <br /> <br />o <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on September 1, 1992 and <br />that said public heating was properly advertised and that the minutes of said public heating <br />are hereby incorporated by reference. <br /> <br />0 <br /> <br />That the subject property is generally known as 7665 Hwy. gl0 N.W. and is legally <br />described as follows: <br /> <br />That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, <br />Range 25, Anoka County, Minnesota, described as follows: Commencing at the <br />intersection of the west line of said Northeast Quarter of the Southwest Quarter with the <br />northerly right of way line of U.S. Highway No. 10; thence Southeasterly along said <br />northerly right of way line a distance of 625.00 feet to the point of beginning of the land to <br />be described; thence continuing Southeasterly along said northerly right of way line a <br />distance of 464.63 feet, more or less, to a point thereon distant 386.98 feet northwesterly <br />of the intersection of said northerly right of way line with the east line of said Northeast <br />Quarter of the Southwest Quarter; thence northeasterly at right angles to said northerly right <br />of way line a distance of 216.17 feet, more or less, to the southerly line of the Burlington <br />Northern Railroad; thence northwesterly along said southerly line of said railroad a distance <br />of 476.91 feet, more or less, to a point thereon distant 691.80 feet southeasterly from its <br />intersection with said west line of said Northeast Quarter of the Southwest Quarter; thence <br />southwesterly a distance of 195.39 feet, more or less, to the point of beginning. Subject to <br />easements of record, if any. <br /> <br />4. That the subject property is approximately 2.2 acres in size. <br /> <br />5. That the subject property is zoned B-3 Business. <br /> <br />6. That the adjacent parcels are zoned B-3 Business. <br /> <br />o <br /> <br />That Section 9.21.23 of the Ramsey City Code states that motor vehicle sales, service and <br />repair is a permitted use in the B-3 Business District. <br /> <br />o <br /> <br />That Section 9.21.23 of the Ramsey City Code also states that a conditional use permit is <br />required if there is an outdoor display area associated with the use of the property. A <br />conditional use permit may be obtained provided outdoor sales/display areas are screened <br />from neighboring residential uses, the sales area is surfaced with asphalt or concrete, the <br />sales area does not take up off-street parking spaces as required by City Code, and the <br /> <br /> <br />
