Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-10-281 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0325 RELATING TO A <br />REQUEST FROM RON DANNER OF DANNER'S CABINET SHOP FOR A <br />CONDITIONAL USE PERMIT TO EXPAND HIS MANUFACTURING <br />OPERATION IN A B-1 BUSINESS DISTRICT <br /> <br />That Mr. Ron Danner, hereinafter referred to as the "Applicant", properly applied for a <br />conditional use permit to expand Danner's Cabinet Shop, a manufacturing operation, in the <br />B-1 Business District. <br /> <br />o <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on October 15, 1992 and <br />that said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />That the subject property is generally known as 16735 Quicksilver Street N.W. and is <br />legally described as follows: <br /> <br />The North 200.00 feet of the West 187.00 feet of Lot 3, Block 7, Klemish Addition, <br />according to the recorded plat thereof, Anoka County, Minnesota. <br /> <br />4. That the subject property is approximately .85 acres in size. <br /> <br />5. That the subject property is zoned B-1 Business. <br /> <br />o <br /> <br />That the adjacent parcels to the south and east are zoned B-1 Business and the adjacent <br />parcels to the north and west are zoned R-1 Rural Residential. <br /> <br />4 <br /> <br />That Section 9.20.21 of the Ramsey City Code states that manufacturing is not a permitted <br />use in the B-1 Business District. <br /> <br />That records indicate that the City issued a building permit for the original construction of <br />the cabinet shop in 1975 and there is no indication of what the property was zoned and if a <br />conditional use permit was necessary. <br /> <br />That records indicate that the City issued a building permit for an expansion of the cabinet <br />shop in 1979 and there is no indication of what the property was zoned and if a conditional <br />use permit was necessary. <br /> <br />10. <br /> <br />That the City approved a variance in 1984 for an expansion of the cabinet shop that would <br />encroach on the rear yard setback. At the time the variance was reviewed, it was noted in <br />the record that the cabinet shop was a non-conforming use and by the variance, the City <br />granted an implied conditional use permit approving the existence and expansion of the <br />cabinet manufacturing operation in the B- 1 Business District. <br /> <br />11. <br /> <br />That Section 9.03.04 of the Ramsey City Code states that an amended conditional use <br />permit may be applied for in a manner similar to that required for a new conditional use <br />permit when there is an expansion of use. <br /> <br /> <br />
