o <br /> <br />o <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />ll. <br /> <br />12. <br /> <br />That the existing garage on the property is 720 square feet; the shed is ,~00 square feet; the <br />proposed accessory garage is 640 square feet; for a total garage and accessory building <br />space of 1,760 square feet; the maximum garage and accessory building space permitted for <br />a 10 acre lot is 5,664 square feet. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located approximately 300 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 200 <br />feet8from the front property line. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the side and rear yards of the subject <br />property are consumed by wetlands and mature tree growth. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant as the home was sited and constructed on the property by persons other than the <br />Applicants. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />That the such variance is necessary for the preservation of a substantial property right <br />similar to that possessed by other properties in the R-1 Rural Residential District. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R-1 Rural Residential District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public streets, <br />or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Bawden and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Terry Hendriksen <br />Commissioner Charles LaDue <br />Commissioner David Bawden <br />Commissioner Ben Deemer <br />Commissioner Michael Terry <br />Commissioner Bradley Thorud <br />Commisioner Paul Holland <br /> <br /> <br />
