Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92.11-292 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT #0328 RELATING TO J. <br />AND KRISTIE WEINMANN'S REQUEST FOR A CONDITIONAL USE PERMIT <br />TO MAINTAIN TWO (2) HORSES ON A PARCEL LESS THAN 3 ACRES IN <br />SIZE AND CONSTRUCT A METAL ACCESSORY STRUCTURE ON A PARCEL <br /> LESS THAN 2.5 ACRES IN SIZE <br /> <br />That J. and Kristie Weinmann, hereinafter referred to as the "Applicants", have properly <br />applied for a conditional use permit to maintain a maximum of two (2) horses on a parcel <br />measuring less than three (3) acres in size and construct a metal accessory structure on a <br />parcel less than two and one-half (2.5) acres in size. <br /> <br />That the Applicants appeared before the Horse Care Commission on October 21, 1992 and <br />that Commission has recommended that the City of Ramsey approve/deny the application to <br />maintain one horse on less than 3 acres. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on November 5, 1992 and <br />that said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />That the subject property is generally known as 7903 157th Avenue N.W. and is legally <br />described as follows: <br /> <br />Lot 3, Block 1, Sorteberg's 2nd Addition, Anoka County, Minnesota <br /> <br />5. That the subject parcel is approximately 2.3 acres in size. <br /> <br />6. That the subject parcel is zoned R-1 Rural Residential. <br /> <br />7. That the surrounding parcels are also zoned R-1 Rural Residential. <br /> <br />That Section 5.09.05 of the Ramsey City Code states that a maximum of 2 horses may be <br />maintained on a parcel ranging in size from 1.5 acres to 3.0 acres with a conditional use <br />permit. <br /> <br />o <br /> <br />That the City has previously approved a similar request for horses on less than 3 acres in <br />the Rural Residential District. <br /> <br />10. <br /> <br />That Section 5.09.04 of the Ramsey City Code states that no stable or barn that houses <br />horses may be located within 50 feet of a place of human habitation and Section 9.20.11 <br />states that no buildings housing animals may be within 75 feet of neighboring property <br />lines. <br /> <br />11. <br /> <br />12. <br /> <br />That the Applicant has submitted a site plan which.indicates that the structure proposed to <br />house the horse will be at least 50 feet from places of human habitation and 75 feet from <br />property lines. <br /> <br />That Section 9.11.02 of the Ramsey City Code states that on parcels less than 2.5 acres in <br />size, the accessory structure shall be built with the same type construction materials and <br />shall have the same general design and exterior facing finish as that of the principal <br />structure on the parcel. <br /> <br /> <br />
