Councilm~ ibel~[Beyer introduced the following resolution and moved for its adoption: RESOLUTION g93-06-123 A REsO! uT~IoN APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT~ TO! DANNY'S TRANNY'S, INC., AND DECLARING TERMS OF SAME. WI~REAS, Daniel Karst, Jr. of Danny's Tranny's, Inc., has properly applied for a condifion~fl~se permit on the property legally described as follows: Lots~2, 3, and 4, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota (Subject Property); and WI-I~R~AS, the Planning and Zoning Commission met on June 1 and June 7, 1993, conducted ~epliblic hearing and recommended City Council approval of the request. NO~V T~'-2EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY O1* ~RA;MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Base~ on. Findings of Fact g0339, a conditional use pemt to disassemble engines and translaxis~ions and conduct wholesale operations is hereby granted to Daniel Karst, Jr., Dan~y's .Tranny's, Inc., hereinafter referred to as "Permit Holder". 2. This ~x~rmit shall remain in effect so long as the conditions imposed herein are complied with .~ 3. NoiS,s emanating from the site and operattons shall be m compliance wath and regulated by the ',State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010~00g0, as amended or except as modified herein by City performance requirements. 4. The ~ssion of odor from the operation shall be in compliance with and regulated by the State,of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as;modified herein by City performance requirements. ' 5. The'City may order the Permit Holder to undertake corrective actions within specific time fram~}S ,based on test results or evaluations to remedy pollution problems or nuisance compares. If the Permit Holder fails to take corrective action within specified time fram-4s, i~.may be determined by the City Council to be a violation of the CUP and cause for p .ermit revocation. 6. DisasSembly of engines and transmissions shall be conducted wholly within a building and in aCebrd~ee with County, State and Federal requirements. 7. All ~iuic[ waste, waste solvents, cleansers, or wastewater generated from the disassembly and ¢~g of vehicle engines or transmissions,shall be collected and stored in a leakproof syst~ in:.~cordance with state and federal re~flatiolis and then ~xansported off site. Waste fluidsish r~!! be stored inside the building in sturdy, leakproof storage containers or tanks in accor/l w~.th MN Rules 7045.0526 or 7045.0528. The Permit Holder shall submit a copy of the[ori~'inal shipping manifest and the completed manifest for hazardous waste quarterly to thelCi~ Zoning Administrator. A copy of the application submittal for a Hazardous Was~F ~a~.ity permit shall be submitted to the City concurrently with submittal to Anoka Cout!~ aiid MPCA. A copy of the final permit, if approved, shall be transmitted to the City ,aiithia five days of receipt.
