Councilm~ ibel~[Beyer introduced the following resolution and moved for its adoption: <br /> RESOLUTION g93-06-123 <br /> <br /> A REsO! uT~IoN APPROVING THE ISSUANCE OF A CONDITIONAL USE <br /> PERMIT~ TO! DANNY'S TRANNY'S, INC., AND DECLARING TERMS OF <br /> SAME. <br /> <br /> WI~REAS, Daniel Karst, Jr. of Danny's Tranny's, Inc., has properly applied for a <br /> condifion~fl~se permit on the property legally described as follows: <br /> <br /> Lots~2, 3, and 4, Block 4, Gateway North Industrial Park Plat #2, Anoka County, <br /> Minnesota (Subject Property); and <br /> WI-I~R~AS, the Planning and Zoning Commission met on June 1 and June 7, 1993, <br /> conducted ~epliblic hearing and recommended City Council approval of the request. <br /> NO~V T~'-2EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY O1* ~RA;MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Base~ on. Findings of Fact g0339, a conditional use pemt to disassemble engines and <br /> translaxis~ions and conduct wholesale operations is hereby granted to Daniel Karst, Jr., <br /> Dan~y's .Tranny's, Inc., hereinafter referred to as "Permit Holder". <br /> <br />2. This ~x~rmit shall remain in effect so long as the conditions imposed herein are complied <br /> with .~ <br /> <br />3. NoiS,s emanating from the site and operattons shall be m compliance wath and regulated by <br /> the ',State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to <br /> 7010~00g0, as amended or except as modified herein by City performance requirements. <br /> <br />4. The ~ssion of odor from the operation shall be in compliance with and regulated by the <br /> State,of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended <br /> except as;modified herein by City performance requirements. <br /> ' <br />5. The'City may order the Permit Holder to undertake corrective actions within specific time <br /> fram~}S ,based on test results or evaluations to remedy pollution problems or nuisance <br /> compares. If the Permit Holder fails to take corrective action within specified time <br /> fram-4s, i~.may be determined by the City Council to be a violation of the CUP and cause <br /> for p .ermit revocation. <br /> <br />6. DisasSembly of engines and transmissions shall be conducted wholly within a building and <br /> in aCebrd~ee with County, State and Federal requirements. <br /> <br />7. All ~iuic[ waste, waste solvents, cleansers, or wastewater generated from the disassembly <br /> and ¢~g of vehicle engines or transmissions,shall be collected and stored in a leakproof <br /> syst~ in:.~cordance with state and federal re~flatiolis and then ~xansported off site. Waste <br /> fluidsish r~!! be stored inside the building in sturdy, leakproof storage containers or tanks in <br /> accor/l w~.th MN Rules 7045.0526 or 7045.0528. The Permit Holder shall submit a copy <br /> of the[ori~'inal shipping manifest and the completed manifest for hazardous waste quarterly <br /> to thelCi~ Zoning Administrator. A copy of the application submittal for a Hazardous <br /> Was~F ~a~.ity permit shall be submitted to the City concurrently with submittal to Anoka <br /> Cout!~ aiid MPCA. A copy of the final permit, if approved, shall be transmitted to the <br /> City ,aiithia five days of receipt. <br /> <br /> <br />
