I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />Thetpla0ement~ design and construction of new structures or additions to existing structures <br />and ~ite'.improvements shall comply with City Code and applicable state codes and OSHA <br />reqturements. <br /> <br />Thelpermit Holder agrees to connect to City sewer and water at the time sewer and water is <br />ext_e~ded to the area and herein agrees to join in a petition for such improvements when <br />such petitions are presented. <br /> <br />In file event this CUP is revoked or the Permit Holder closes operation of the facility for <br />any irea~on, including but without limitation, by order of the court or other agency of <br />competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall <br />in~_~ ~ediately proceed to remove all materials from the site. In the event the Permit Holder <br />fails~to comply with the terms of this CUP, the City may, upon 30 days' written notice to <br />the Permit Holder, enter into the property and perform all such obligations, the costs of <br />whith shall be borne by the Permit Holder or, in default thereof, by its surety. <br /> <br />Dan~y'sTranny's, Inc. shall submit financial assurances as follows: <br /> <br />(a) .~ Charges and Fees. Danny's Tranny's, Inc. agrees to pay to the City upon the <br /> I issuance of this CUP a fee in an amount sufficient to reimburse the City for <br /> e~ngineering, legal and administrative expenses reasonably incurred during the <br /> ~nsideration and development of this CUP. The Permit Holder shall maintain a <br /> r~irnum balance of Five Hundred Dollars ($500.00) in the CUP escrow account at <br /> ~ ail times for as long as the conditional use permit is in force and shall reimburse the <br /> City for all fees incurred by the City in connection with inspection of the facility and <br /> administration of this CUP. <br /> <br />(b) <br /> <br />In the event the City incurs additional reasonable costs occasioned solely by the <br />presence of this use within the City of Ramsay for personnel training, specialized <br />exluipment, risk insurance or increased contract costs for providing £n'e department <br />services, the Permit Holder agrees to reimburse the City at cost upon presentation <br />of supporting documents and invoices consistent with applicable law. <br /> <br />Liability Insurance and Liability Indemnification. The Permit Holder shall secure <br />and maintain insurance from an insurance company acceptable to the City and <br />authorized to write casualty insurance in the State of Minnesota which will protect <br />the Permit Holder, its agents and employees and the City from claims for bodily <br />injury, death or property damage which may arise from the operations on the <br />Subject Property. The Permit Holder shall file a certificate of insurance or a <br />certified copy of the insurance policy with the City. Such insurance policy shall <br />contain a clause providing that it shall not be cancelled by the insurance company <br />without thirty (30) days' written notice to the City of intention to cancel. The <br />following coverages shall be provided in amounts not less than those specified: <br /> <br />i. Public liability, general liability, personal injury and property damage: <br /> <br />(1) <br />(2) <br />(3) <br />(4) <br /> <br />Injury or death of one person - $1,000,000. <br />Injury to more than one person in a single accident - $1,000,000. <br />Property damage - $1,000,000. <br />Total Aggregate Liability for all items $1,000,000. <br /> <br />Automobile and truck public liability personal injury and property damage <br />including owned and leased vehicles: <br /> <br /> <br />
