Thelpermit Holder agrees to connect to City sewer and water at the time sewer and water is ext_e~ded to the area and herein agrees to join in a petition for such improvements when such petitions are presented. In file event this CUP is revoked or the Permit Holder closes operation of the facility for any irea~on, including but without limitation, by order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall in~_~ ~ediately proceed to remove all materials from the site. In the event the Permit Holder fails~to comply with the terms of this CUP, the City may, upon 30 days' written notice to the Permit Holder, enter into the property and perform all such obligations, the costs of whith shall be borne by the Permit Holder or, in default thereof, by its surety. Dan~y'sTranny's, Inc. shall submit financial assurances as follows: (a) .~ Charges and Fees. Danny's Tranny's, Inc. agrees to pay to the City upon the I issuance of this CUP a fee in an amount sufficient to reimburse the City for e~ngineering, legal and administrative expenses reasonably incurred during the ~nsideration and development of this CUP. The Permit Holder shall maintain a r~irnum balance of Five Hundred Dollars ($500.00) in the CUP escrow account at ~ ail times for as long as the conditional use permit is in force and shall reimburse the City for all fees incurred by the City in connection with inspection of the facility and administration of this CUP. (b) In the event the City incurs additional reasonable costs occasioned solely by the presence of this use within the City of Ramsay for personnel training, specialized exluipment, risk insurance or increased contract costs for providing £n'e department services, the Permit Holder agrees to reimburse the City at cost upon presentation of supporting documents and invoices consistent with applicable law. Liability Insurance and Liability Indemnification. The Permit Holder shall secure and maintain insurance from an insurance company acceptable to the City and authorized to write casualty insurance in the State of Minnesota which will protect the Permit Holder, its agents and employees and the City from claims for bodily injury, death or property damage which may arise from the operations on the Subject Property. The Permit Holder shall file a certificate of insurance or a certified copy of the insurance policy with the City. Such insurance policy shall contain a clause providing that it shall not be cancelled by the insurance company without thirty (30) days' written notice to the City of intention to cancel. The following coverages shall be provided in amounts not less than those specified: i. Public liability, general liability, personal injury and property damage: (1) (2) (3) (4) Injury or death of one person - $1,000,000. Injury to more than one person in a single accident - $1,000,000.
