Board Member Holland introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-03-053 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0357 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE SIDE YARD SETBACK <br />REQUIREMENTS IN THE B-3 HIGHWAY BUSINESS DISTRICT AND THE <br />IMPERVIOUS SURFACE AREA REQUIREMENTS IN THE CRITICAL RIVER <br />CORRIDOR <br /> <br /> WHEREAS, Lakeview Enterprises, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment variance from Section 9.21.07 (Critical River Overlay <br />District Development Standards) and Section 9.21.23 (B-3 Highway Business District) of the <br />Ramsey City Code to develop a property with 90% impervious surface area and zero side yard <br />setback on the north side yard on the property legally described as follows: <br /> <br />Lot 3, Block 3, RIVERSIDE WEST, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on March 17, 1994 and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the subject property is zoned B-3 Highway Business and is approximately 1.1 acres in <br />size. <br /> <br />3. That the subject property is located in the Critical River Overlay District. <br /> <br />That the property to the north and east is zoned B-3 Highway Business, the property to the <br />south is zoned R-1 Urban Residential, and the property to the west is zoned R-1 Urban <br />Residential and Park. <br /> <br />That Section 9.21.23 (B-3 Highway Business District) of the Ramsey City Code requires a <br />10 foot side yard setback. <br /> <br />o <br /> <br />That the Applicant is proposing to develop self-service storage facilities on the subject <br />property with a zero side yard setback along the north property line in order to achieve <br />consistency in spacing with the self-service storage facilities currently existing on Lots 1 <br />and 2, Block 3, Riverside West. <br /> <br />That in 1987, the City of Ramsey granted a variance to the rear yard setback for the self- <br />service storage facilities on Lot 1, Block 3, Riverside West to be developed with a 5 foot <br />rear yard setback to achieve spacing consistency with the facilities then existing on Lot 2. <br /> <br />That Section 9.21.07 (Critical River Overlay District Development Standards) of the <br />Ramsey City Code restricts the impervious surface area to 30% of the lot in order to <br />maintain the water quality and prevent pollution of the Mississippi River and preserve the <br />natural aesthetic value of the corridor. <br /> <br /> <br />
