10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />That .the Subject Property is not visible from the Mississippi River and the Applicant has <br />propOsed a drainage plan that provides for a detention volume consisting of a water <br />retention/sedimentation system that will limit the surface water discharged from the Subject <br />Property into the existing storm water system to 1.7 cfs; the Applicant has stated that he <br />will further restrict the surface water discharged from the Subject Property into the existing <br />storm water system to that which would normally be expected if the property was <br />developed with 30% impervious surface area. <br /> <br />That in 1986, the City of Ramsey granted a variance to the impervious surface area <br />requirement for Lot 2, Block 3, Riverside West to be developed with self-service storage <br />facilities at an impervious surface area coverage of 85%. <br /> <br />That although City records reflect there was verbal approval by the Department of Natural <br />Resources for the variance granted in 1986 to Lot 2, Block 3, Riverside West, there is no <br />written documentation of such approval. <br /> <br />That the Applicants request for a variance to the impervious surface area has been <br />forwarded to the Department of Natural Resources, the Environmental Quality Board, and <br />the Metropolitan Council for review and comment. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district. Namely: a) the subject property is in the Critical <br />Overlay District and lot development is restricted to 30% of the lot area; b) Lots 1 and 2 <br />were allowed to be developed beyond the 30% impervious surface area limit and with no <br />side yard setbacks; c) the development of the subject property is an expansion of the <br />development that has occurred on Lots 1 and 2; d) City Code requires that all off-street <br />parking, driveways and maneuvering areas be paved and curbed in the Business district. <br /> <br />That the proposed coverage of the lot by buildings is approximately 30%, which is in <br />accordance with the regulations for the B-3 Highway Business District. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That such variance is necessary for the preservation of a substantial property right similar to <br />that possessed by other properties in the B-3 Highway Business District. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the B-3 Highway Business District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public streets, <br />or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />That the Applicant has stated that he will submit and implement drainage plans which call <br />for on-site retention/percolation of run-off water for 40% of the impervious surface area <br />and on-site sedimentation and skimming of run-off from the remaining 60% impervious <br />surface area with discharge to the municipal storm sewer system restricted to 1.3 cfs, such <br />figure being the estimated flow resulting from a 30% impervious surface area coverage. <br /> <br />That the Subject Property, by the City Engineer's estimate and the accompanying letters <br />submitted in the public hearing record, is entitled to a surface water discharge of 1.7 cfs to <br />the existing City storm water system discharging into the Mississippi River. <br /> <br /> <br />
