18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />Only State, County and City streets constructed to 9 ton standard shall be used as haul <br />roads. The only City streets designated as haul roads for the operation shall be Ferret <br />Street N.W. north of 147th Avenue N.W. and 147th Avenue N.W. between Ferret Street <br />N.W. and Armstrong Blvd. N.W. The Permit Holder shall provide access from the site to <br />the City street at a single point and a 50 foot length of crushed gravel shall be placed from <br />this point into the site to minimize tracking dirt residue onto the City streets. <br /> <br />All mining operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only <br />unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No operation <br />shall be allowed when wind gust exceed 30 miles per hour. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the protection <br />of water quality. <br /> <br />All haul roads are subject to the approval of the City Engineer. While hauling operations <br />are in progress, the permit holder shall maintain the haul road in a condition satisfactory to <br />the City Engineer. When hauling operations are completed, the permit holder shall either <br />restore that haul road to a condition at least equal to that which existed at the time the <br />hauling operations were started, or compensate the local road authority in an amount <br />satisfactory to that road authority and concurred in by the City Engineer for the restoration <br />of that haul road. The City Engineer will then accept such restoration or concur in such <br />financial settlement for the restoration of the haul road in writing and such acceptance will <br />relieve the permit holder of any additional obligation in connection with the restoration of <br />the haul roads. If the permit holder fails or refuses to perform haul road restoration or to <br />make satisfactory financial settlement for such restoration, the City will cause the <br />restoration work to be done and require reimbursement from the financial guarantee <br />required herein. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember Hardin <br />and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Acting Mayor Kenneth Peterson <br /> Councilmember Gerald Zimmerman <br /> Councilmember Glen Hardin <br /> <br />and the following voted against the same <br /> <br /> None <br /> <br />and the following abstained <br /> <br /> None <br /> <br />and the following were absent <br /> <br /> Mayor James Gilbertson <br /> Councilmember Sheila Beyer <br /> <br /> <br />
