o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />That by State Statute, the Applicant's proposal is considered a muldfamily use in a single <br />family district. <br /> <br />That the subject property is surrounded by R-1 Rural Residential or single family zoning. <br /> <br />That on March 7, 1995, the Planning Commission called the public hearing to order in an <br />attempt to receive public input on the issue, when a positive City action in fact will result in <br />a spot rezoning. <br /> <br />That to locate a multi-family use in a single family district is not permitted by the <br />Conditional Use Permit process as this is a re-zoning issue. <br /> <br />That a multi-family use is not compatible in a single family residential zone. <br /> <br />That permitting a multi-family use in a single family residential zone is not consistent with <br />the intent and purposes of the City's Zoning Chapter and is not harmonious with the <br />objectives of the Comprehensive Plan. <br /> <br />That historically, the records show that the City has permitted other multi-family uses in <br />single family residential zones; specifically two permits were issued in 1977 for duplexes in <br />single family districts and a permit was issued in 1993 and in 1994 for accessory <br />apartments within single family residences in single family districts. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Peterson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Glen Hardin <br /> Councilmember Gerald Zimmerman <br /> Councilmember Kenneth Peterson <br /> Councilmember Carolyn Beahen <br /> <br />and the following voted against the same: <br /> <br /> Councilmember Sheila Beyer <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> None <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey City Council this the 25th <br />day of April, 1995. ~_~ ~~~) <br /> <br />~~su'ator ' <br /> <br /> <br />
