o 10. 11. 12. That by State Statute, the Applicant's proposal is considered a muldfamily use in a single family district. That the subject property is surrounded by R-1 Rural Residential or single family zoning. That on March 7, 1995, the Planning Commission called the public hearing to order in an attempt to receive public input on the issue, when a positive City action in fact will result in a spot rezoning. That to locate a multi-family use in a single family district is not permitted by the Conditional Use Permit process as this is a re-zoning issue. That a multi-family use is not compatible in a single family residential zone. That permitting a multi-family use in a single family residential zone is not consistent with the intent and purposes of the City's Zoning Chapter and is not harmonious with the objectives of the Comprehensive Plan. That historically, the records show that the City has permitted other multi-family uses in single family residential zones; specifically two permits were issued in 1977 for duplexes in single family districts and a permit was issued in 1993 and in 1994 for accessory apartments within single family residences in single family districts. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Peterson and upon vote being taken thereon, the following voted in favor thereof: Mayor Glen Hardin Councilmember Gerald Zimmerman Councilmember Kenneth Peterson Councilmember Carolyn Beahen and the following voted against the same: Councilmember Sheila Beyer and the following abstained: None and the following were absent: None whereupon said resolution was declared duly adopted by the Ramsey City Council this the 25th day of April, 1995. ~_~ ~~~) ~~su'ator '
