No work shall be commenced (grading, tree removal, etc) until all of the above . <br />contingencies are completed to the satisfaction of City Staff. <br /> <br />Councilmember Cook asked if Kelly Acres will have the same seven contingencies. <br /> <br />Community Development Director Trudgeon replied the contingencies will be the same, with the <br />exception of number 5; the second access needed by Kelly Acres is through 170tll Avenue. There <br />are some things these two developers are trying to work out, and he is not certain what that status <br />is. Any approval considered tonight would need to meet all of the contingencies. <br /> <br />Councilmember Strommen noted these contingencies put a burden onto staff. She asked if staff <br />is comfortable with the approval and all of these contingencies. <br /> <br />Community Development Director Trudgeon indicated staff did a thorough review to be certain <br />everything is covered. The big things are to continue working on the development agreement, <br />the covenants needs to be reviewed, and the PCA licenses are very important. Staff feels things <br />are covered if the Council is comfortable moving ahead . <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Resolution #06- <br />06-198 approving the final plat for Rum River Prairie, contingent upon the following items: <br /> <br />1. Compliance with City Staff Review Letter dated June 23, 2006. <br />2. The developer obtaining a permit for community septic system construction from the . <br />Minnesota Pollution Control Agency. <br />3. The City's review and acceptance of the Articles of Incorporation, Declaration of <br />Covenants, and [mancial responsibilities for the Home Owner's Association. <br />4. The developer engaging the services of a professional management firm to manage the <br />community septic system and submitting an agreement with the management firm. <br />5. A second access is obtained through the construction of 171" Avenue. <br />6. The developer entering into a Development Agreement that will address the payment of <br />Sewer and Water Trunk and Access Charges. <br />7. Absent: Councilmember Jeffrey. <br /> <br />Councilmember Elvig left the Council dais. <br /> <br />Case #8: <br /> <br />Request for Final Plat Approval of Kelly Acres: Case of Kelly Wolf and John <br />Osborne <br /> <br />Community Development Director Trudgeon indicated this development is directly north and is <br />tied into the Prairie Meadows plat that was just approved.
