CASE # 3 CONSIDER APPROVAL OF ACQUISITION OF EASEMENTS FOR THE NW TRUNK SANITARY SEWER EXTENSION By: Director of Public Works/Principal City Engineer Background: The City Council authorized Bolton & Menk, Inc to begin design of the infrastructure for extension of sewer and water to petitioning properties on May I I, 2004. The costs were to be paid from the respective enterprise funds and be reimbursed from the bond proceeds when and if the projects were approved. The City Council directed staff to implement a public participation program on December 6, 2004. The program included property owners in the area identified as the NW Sewer Extension. The City held an informational meeting on February 7,2005 with residents that could be impacted by sewer and water extension. There were five (5) alignments under consideration and all residents adjacent to the proposed alignments were invited to participate in the meeting. The City Council concurred with the Staffrecommendation that Option 3 be selected as the alignment for this sewer extension at a work session March 15, 2005. The recommendation was based on review of the advantages and disadvantages of each alignment and consideration of public comments received. The City Council selected the alignment on April 12, 2005. Staff was directed to notify residents adjacent to Alignment No.3 on June 9, 2005. The purpose of this notification was to begin the process of acquiring the easements necessary for construction of the sewer and water lines. The majority of the properties need to be acquired before issuing the bids for the proj ecl. The City Council authorized staff to retain Tinklenberg Group andProsource Technologies on August 23, 2005. These firms will contact each property owner individually, negotiate the necessary easement and prepare the necessary documents to transfer the easements to the city. On September 27,2005, the City Council approved the completed negotiations for 10 parcels along the proj ect. On November 22, 2005, the City Council approved an additional 8 parcels along the project and we were able to slightly modify the project to keep the limits of construction within existing drainage and utility easements for an additional 5 parcels. On December 13,2005, the City Council authorized the use of eminent domain for the remaining parcels for the sewer line only. -95-
