Range 25, with the South and West line of the Anoka and Elk River Road, so-called, and <br />which is known as Trunk Highway Number 3; thence Northwesterly along the South and <br />West line of said trunk highway number 3 a distance of 200 feet; thence in a Southwesterly <br />direction to a point on the South line of said Section 19 which point is distant 270 feet West <br />of the point where the South line of said Section 10 intersects the center of the paving, as <br />the same is now laid, built and'constructed on said trunk highway number 3; thence East on <br />the South line of said Section 19 to the point of commencement; also excepting all that part <br />thereof now used for highway purposes. <br /> <br />10. <br /> <br />11. <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on May 24, 1995 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the subject pwperty is zoned R-1 Rural Residential and is approximately one (1) acre <br />in size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That .Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located approximately 78 feet from the <br />centerline of Bowers Drive N.W.. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 67 feet <br />from the centerline of Bowers Drive N.W. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the side and rear yards of the subject <br />property are consumed by on site septic system, well, mature tree growth and declines in <br />topography. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey and particularly along Bowers Drive N.W. due to the Mississippi River setback <br />requirements. <br /> <br />That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />That such variance is necessary for the preservation of a substantial property right similar to <br />that possessed by other properties in the R- 1 Rural Residential District. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R- 1 Rural Residential District. <br /> <br /> <br />
