<br />a. Keep the new Potassium Street road alignment as far west as possible and <br />construct it to 24' (curb to curb) in width, with the west side curb to be concrete <br />and the east side to be bituminous curb. <br />b. Require the establishment of a temporary public road access from Quicksilver <br />Circle to CSAH #5 through the Shade Tree Cottages development conditioned on <br />the affected property owners on Potassium Street agreeing in writing to convey <br />the necessary easement for the new Potassium Street road alignment to the City <br />by September I, 2005. <br />c. Staff is directed to negotiate first rights of refusal with the property owners of the <br />four properties located in the NE comer of County #5 and Alpine Road for <br />purposes of acquiring roadway easements for a routing from Potassium to Alpine <br />with the purpose being the eventual closure of all accesses on County #5 from <br />157th to Alpine Road, including the closure of the temporary public road access <br />from Quicksilver Circle to CSAH #5 described in (b) above. <br />d. Close and cul-de-sac one of the accesses to CSAH #5 from the Nowthen <br />Boulevard. <br /> <br />Community Development Director Trudgeon stated staff has had negotiations with all of the <br />property owners along Potassium Street that will be affected by the new Potassium Street <br />construction. A hearing regarding the eminent domain action will take place on June 23, 2006. <br />It is expected that the City will receive title to the property on August 18, 2006, assuming that <br />the court agrees with the public purpose of the condemnation. The alignment of Potassium <br />Street has been deliberated between the City, Lower Rum River WMO, the residents of <br />Potassium Street, and the developer. The alignment shown on the submitted plans conforms <br />with the City Council's desire to keep the road width to 24 feet and as far west as possible. The <br />extension of the Quicksilver Circle is no longer required since there was no agreement to convey <br />the needed right-of-way for Potassium Street by September 1, 2005. Mr. Trudgeon stated now <br />that it appears the Shadetree Cottages subdivision will go forward, staff will begin to contact the <br />four property owners at the NE comer of CR 5 and Alpine Drive for the right of first refusal on <br />their properties. In regards to the closing of the accesses from Old Nowthen to CSAH #5, this <br />improvement was included into the CIP in October 2005. The CIP anticipates the improvement <br />being constructed in 2008. As the CIP is only a guiding and planning document, funding will <br />need to be secured prior to the expected improvements. <br /> <br />Community Development Director Trudgeon stated the landscaping plan is acceptable. Staff is <br />pleased to see that wetland buffers are proposed around most of the wetlands within this site. <br />Buffer monumentation will be required along the edge of the buffer areas at a spacing not to <br />exceed 200 feet. The grading and drainage plan will need to be revised in accordance with the <br />staff review letter and Engineer's Memo. The proposed plat will pay park dedication fees and <br />will contain trails throughout the development as well as along Nowthen Boulevard. <br /> <br />Community Development Director Trudgeon advised the cost of acquisition and construction of <br />Potassium Street will be shared between the City, Shadetree Communities, and National Growth <br />LLC. It has been agreed that the City would pay for 50% of the cost of securing the necessary <br />right-of-way and construction of Potassium Street that will serve both Shadetree Cottages and <br />Rum River Estates. The developers of these two subdivisions will pay for the remaining 50% of <br /> <br />City Council! June 13,2006 <br />Page 15 of26 <br />
