An agreement is being drafted between the City, Shadetree Cottages, and National <br />Growth to formalize this cost sharing agreement. <br /> <br />Community Development Director Trudgeon advised staff is recommending approval of the <br />final plat and final site plan subject to the following: <br />1. Compliance with City Staff Review Letter dated June 9, 2006 <br />2. Compliance with Engineer's Memo dated June 9, 2006 <br />3. The City and the Developer entering into a Development Agreement <br />4. Final acquisition of Potassium Street <br />5. Entering into agreement for the cost sharing between the City and developers <br /> <br />Community Development Director Trudgeon explained the developer has applied for a building <br />permit for one unit on the site; as a free standing site this is allowed. However, there are <br />documents that will need to be wrapped up to allow for even one unit. Once those documents <br />are completed work on that unit will be starting quickly. <br /> <br />Councilmember Jeffrey questioned if the building application for the one unit will also include <br />the same contingencies as the rest of the plat. <br /> <br />Community Development Director Trudgeon replied as a freestanding parcel a building permit <br />can be obtained if there is the appropriate frontage and a driveway on the site. However, to <br />conform to the development plan the applicant will need to do grading, provide a letter of credit, <br />and sign a development agreement; it is not as simple as pulling a building permit and building a <br />house. The unit would be built on Lot I, Block 2. It will be coming off an existing street. <br /> <br />Councilmember Cook stated the single unit is a separate issue from the final plat and site plan <br />approval. <br /> <br />Councilmember Jeffrey questioned if this one unit should be part of the entire plat, which <br />includes many contingencies. <br /> <br />City Attorney Goodrich indicated proceeding with the one unit is the developer's gamble; they <br />could come in without ever having talked to the City about platting for this building permit. <br /> <br />Community Development Director Trudgeon explained the motion that is being considered <br />includes contingencies and to some extent the developer is proceeding at their own risk with the <br />possibility of the unit needing to be moved or tom down if the contingencies are not met. <br /> <br />Councilmember Jeffrey explained his concern would be granting final plat approval based on <br />contingencies, yet allowing the developer to build a house on this lot, as the developer is really <br />being granted access to build on the final plat. <br /> <br />City Attorney Goodrich advised the City is not granting the developer the right to build on a <br />platted lot; the developer has the right to build on this parcel. <br /> <br />City Council!
