Board Member Hendriksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g95-06-124 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT g0377 RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Jeffrey Wise, hereinafter referred to as "Applicant", has properly applied for <br />a variance from Section 9.11.02 of the Ramsey City Code to construct an accessory garage nearer <br />the front property line than the principal structure on the property generally known as 7901 165th <br />Avenue N.W. and legally described as follows: <br /> <br />Lot 3, Block 3, Trott Brook Ridge, Anoka County, Minnesota. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of <br />the Ramsey City Code on June 21, 1995 and that'said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately three (3) <br />acres in size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located approximately 148 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 116 feet <br />from the front prop,ny line. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the side yards are consumed by on-site <br />septic system, well, and substantial, mature tree growth and rear yard consists of wetlands, <br />heavy tree growth and sharp declines in topography. <br /> <br />That the special condition causing the undue hardship (a 148 foot setback for accessory <br />structures) was caused by the Applicant siting the home on the lot; however, there are a <br />substantial number of mature trees on the site and the placement of the home was based on <br />the least amount of tree removal. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />10. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br /> <br />
