Board Meml~r Bawden introduced the following resolution and moved for its adoptio,. <br /> <br />179328 <br /> <br /> RESOLUTION #95-07-151 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Joel and JoDee Nelson have properly applied for a variance from minimum <br />street frontage or lot width requirements in order to construct a dwelling on the property legally <br />described as follows: <br /> <br />Thc east half of the Northwest Quarter of the Northwest Quarter of Section 7, Township <br />32, Range 25, Anoka County, Minnesota. <br /> <br />CSubject Property") <br /> <br /> WHEREAS, thc Board of Adjustment met on July 20, 1995, conducted the public <br />hearing and adopted findings of fact. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact g0381, a variance from minimum street frontage and lot width <br />requirements to construct a dwelling on the Subject Property is hereby granted. <br /> <br />The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />additional residential structures will be issued until such time as the Subject Property is <br />replatted and developed to a higher density in accordance with City Code. <br /> <br />Only one private drivev~ay from the Subject Property will be granted access to 173rd <br />Avenue N.W. Said driveway shall be surfaced with bituminous, concrete or Class 5 and it <br />shall access 173rd at the same point at which the existing private driveway for the adjacent <br />parcel to the north does. The property owner shall also be responsible for shaping or <br />grading a Class 5 temporary mm-around in the form of a bulb or hammerhead at the <br />western terminus of 173rd Avenue N.W. in accordance with the specifications of the City <br />Engineer to facilitate maneuverability of public maintenance vehicles. The property owner <br />shall be responsible for creating a driveway and temporary turn-around that does not cause <br />erosion or an inordinate amount of runoff and sedimentation onto 173rd Avenue N.W. <br />The property owner shall obtain prior approval of the driveway and mm-around plans from <br />the City Engineer, which shall include submittal of topographies for the subject area. The <br />creation of the driveway and tm-around shall be complete and accepted by the City <br />Engineer prior to issuance of a certificate of occupancy for the dwelling. <br /> <br />w <br /> <br />At such time as the subject property is replatted to a higher density, the residential structure <br />located on the Subject Property shall convert its egress to a public road within said plat, at <br />the expense of the property owner. Said mad is anticipated to be a southerly extension off <br />of a westerly of 173rd Avenue N.W. In the interim, the property owner agrees to join in <br />an initial petition calling for a feasibility study for the extension of 173rd Avenue N.W., <br />when and if such a petition is presented. <br /> <br />The property owner agrees to convey by deed at no expense to the City, an easement for <br />street purposes over and across the North 40 feet of the Subject Property. <br /> <br /> <br />
