That the property owner of the Subject Property shall participate in any street maintenance <br />assessments to 173rd Avenue N.W., the street from which it receives the benefit of public <br />access, until such time as the Subject Property is platted and served by public streets <br />interior to the plat. <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. The residential structure and any accessory buildings constructed on the <br />Subject Property shall not interfere with the orderly resubdivision of the Subject Property at <br />some point in the future, and shall be located in such a way as to comply with rural <br />residential setback requirements and Item g4 above. <br /> <br />The property owner agrees that this variance shall be recorded in the office of the Anoka <br />County Recorder and agrees that the terms and provisions of this Agreement shall run with <br />the land and shall bind the property owner and his/her successor and assigns. <br /> <br />The property owner shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution Was duly Seconded by Board Member <br />Terry and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Ben Deemer <br />Board Member David Bawden <br />Board Member Michael Terry <br />Board Member Bradley Thorud <br />Board Member Charles LaDue <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Board. Member Patti Holland <br />Board Member Terry Hendriksen <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br />20th day July, 1995. <br /> <br />Joel Nelson and JoDee Nelson hereby acknowledge receipt of this variance and that they have <br />reviewed the terms of the variance and have agreed that they will comply with the terms of the <br />variance. <br /> <br /> <br />
