Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION g95-07-157 A RESOLUTION ADOPTING FINDINGS OF FACT #0382 RELATING TO A REQUEST FOR A HOME OCCUPATION ON THE PROPERTY GENERALLY KNOWN AS 14794 KRYPTON COURT N.W. WHEREAS, Diane Dempsey, hereinafter referred to as "Applicant", has properly applied for a Home Occupation to conduct doll-making classes on the property generally known as 14794 Krypton Court N.W. and legally described as follows: Lot 5, Block 3, WOOD POND HILLS 3RD ADDITION; Anoka County, State of Minnesota. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That. the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home Occupations) of the Ramsey City Code on May 3, 1994 and that said public hearing was properly advertised and that the minutes of said public hearing were incorporated into Findings of Fact g0362 by reference. That in the absence of neighbors in the newly developing neighborhood, the Ramsey City Council granted an interim use permit for the home occupation for a one year period. That in accordance with the terms of the interim use permit issued on May 3, 1994, the Applicant has reapplied for a home occupation permit. That the Applicant reappeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home Occupations) of the Ramsey City Code on July 5, 1995 and that said public heating was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the subject property is zoned R-1 Urban Residential and is approximately 13,000 square feet in size. 6. That commercial activities are not a permitted use in the R-1 Urban Residential District. 7. That the subject property is.surrounded by R-1 Urban Residential zoning. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property and that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling. 9. That the Applicant will reside at the location of the proposed home occupation. 10. That the Applicant has stated that the home occupation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. 11. That the Applicant has stated that there will be no exterior storage of business equipment and materials.
