Councilmember Bey.er introduced the following resolution and moved for its adoption: RESOLUTION #95-07-160 A RESOLUTION APPROVING THE ISSUANCE OF A DWELLING MOVING PERMIT AND DECLARING TERMS OF SAME WHEREAS, Fred and Jeanette Mertens have properly applied for a Dwelling Moving Permit for the placement of a modular home on the property legally described as follows: Lot 8, Block 1, PINEVIEW ESTATES 2ND ADDITION, Anoka County, Minnesota (Subject Property); and WHEREAS, the Planning Commission met on July 5, 1995, to review the application submittals and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: A Dwelling Moving Permit, hereinafter referred to as "Permit", is hereby granted to Fred and Jeanette Mertens, hereinafter referred to as "Permittee", for the placement of a modular home, hereinafter referred to as "Structure", on Lot 8, Block 1, Pineview Estates 2nd Addition, hereinafter referred to as "Subject Property". 2. That the Permittee shall provide the City with proof of ownership of the Subject Property. That the placement of the Structure shall comply with all City Codes and the Permittee shall acquire all necessary permits, local or otherwise, including a building permit. That the Permittee shall be responsible for prodding the City with proof that the transporter of the Structure is licensed to operate in the State of Minnesota and all necessary permits have been obtained. That no building permit will be issued for the Structure to be moved into the City unless the financial guarantee described in Paragraph 9 has been satisfied. o That all plumbing shall be tested in accordance with the requirements of the State Plumbing Code. o That all electrical circuits shall be tested in accordance with the requirements of the State Electrical Code. That the establishment of the Structure on the Subject Property shall be completed and receive certificate of occupancy by December 1, 1995. Failure to complete the project by December 1, 1995, will permit the City to draw upon the financial guarantee required in paragraph 7 of this agreement. o That the Permittee shall provide the City of Ramsey with a financial guarantee in the form of cash or a letter of credit, approved as to form by the City, in the amount of Two Thousand Five Hundred Dollars and no cents ($2,500.00) for the purpose of guaranteeing compliance with thc.tc.rms of th. is Permit and satisfactory completion of the project, as determined by the Building Official.
