10. 11. Upon the issuance of a certificate of occupancy, the financial guarantee shall be returned to the Permittce. In the event thc Permittec fails to complete the project, the City may complete the project or perform any remedial action necessary with City day labor and/or by letting contracts for said completion and draw upon the escrow for payment. The Pcrmittee hereby grants permission and a licensc to the City and/or its contractors and assigns to enter upon the Site for the purpose of completing the project or performing remedial action in the event of the Permittee's default. That the Permittee hereby agrees to reimburse the City for all expenses incurred in administering and enforcing this Permit. Failure to pay the City expenses incurred within 15 days of billing by the City shall also permit the City to draw upon the financial guarantee required by this Permit. The City Administrator or his designee shall have the right to inspect the premises for compliance purposes at any time upon reasonable request. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beahen and upon vote being taken thereon, the following voted in favor thereof: Mayor Glen Hardin Councilmcmber Gerald Zimmerman Councilmember Carolyn Beahen Councilmember Kenneth Peterson Councilmcmber Sheila Beyer and the following voted against the same: None and the following abstained: None and the following were absent: None whereupon said resolution was declared duly adopted by the Ramsey City Council this the 25th day of July, 1995. Fred and Jeanette Mertens hereby acknowledge receipt of this Permit and that they have reviewed the terms of the Permit and have agreed that they will comply with the terms of the Permit.
