Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-08-167 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0383 RELATING TO A <br />REQUEST FROM GOOD VALUE HOMES, INC. FOR A CONDITIONAL USE <br />PERMIT TO GRADE AND EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from Good Value Homes, Inc. <br />for a conditional use permit to grade and export excess soils from the property legally described as <br />follows: <br /> <br />Ouflot A, Chestnut Ridge, Anoka County, Minnesota. <br /> <br />That part of the Northwest Quarter of the Northeast Quarter of Section 26, Township 32, <br />Range 25, Anoka County, Minnesota, lying south of County Ditch #43. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That on July 20, 1995, Good Value Homes, Inc., hereinafter referred to as "Applicant", <br />properly applied for a conditional use permit to grade and export excess soils from the <br />proposed plat of Chestnut Ridge 2nd Addition, which plat received preliminary plat <br />approval from the City Council on August 22, 1994. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on August 1, 1995, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the subject property is zoned R-1 Urban Residential, is approximately 65 acres in size <br />and is proposed to be developed with 72 single family lots. <br /> <br />That Section 9.11.18 (Grading, Mining and Filling Permits) states that a conditional use <br />permit shall be required to grade individual lots by more than 3 feet in depth, fill individual <br />lots by more than 2 feet at any point, and excavate more than 400 cubic yards of earth <br /> <br />That the grading plan submitted was prepared by Passe Engineering, Inc. and is dated <br />August 11, 1994 and it proposes to regrade the Subject Property to create more attractive <br />building sites. <br /> <br />That the Applicant is proposing to strip the topsoil on the Subject Property, export <br />approximately 15,000 cubic yards of earth material, and replace the topsoil. <br /> <br /> <br />
