Boros, <br />husband and wife as joint tenants <br /> <br />Parcel 14 <br />CITY OF RAMSEY EASEMENT PLAT NO. 1 <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the easements as described above <br />in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate. <br />and represent the City of Ramsey in ail proceedings. <br /> <br />That if the easements as described above cannot be acquired by direct negotiation, they <br />shall be acquired by eminent domain. <br /> <br />That the City Council hereby authorizes acquisition of the said easements by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />o <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to prosecute <br />such action to a successful conclusion or until it is abandoned, dismissed or terminated by <br />the City or Court. <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisais of the <br />damages to the owners of the Property as a result of the takings herein. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Beyer and upon vote being taken thereon, the following voted in favor thereof.' <br /> <br />Mayor Hardin <br />Councilmember Zimmerman <br />Councilmember Beyer <br />Councilmember Beahen <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br /> whereupon said resolution was declared duly passed anddaclppted ]~th~ gamsey City Council this <br /> the 26th day of September, 1995. -~~-~3~ ~-~~~_ ~. <br /> Mayor <br /> ATTE~~ <br />~AdJ~-ministrat3r <br /> <br />RESOLUTION g95-09-215 <br /> Page 2 of 2 <br /> <br /> <br />
