Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g95-10-239 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT g0387 TO REZONE CERTAIN <br />PROPERTY FROM B-3 HIGHWAY BUSINESS TO R-I URBAN RESIDENTIAL <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey City Code; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That L.A.N.D. Properties, hereinafter referred to as "Applicant", has properly applied to <br />rezone certain property from B-3 Highway Business to R-1 Urban Residential. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on October 3, 1995 and that said public hearing was properly advertised and <br />that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />That part of Lots 12 and 13, AUDITORS SUBDIVISION NUMBER 30, Anoka County, <br />Minnesota, according to the record plat thereof, which lies easterly of the following "Line <br />A", westerly of the following described "Line B", and southerly of the southerly line of <br />Tract B, REGISTERED LAND SURVEY NO. 119, Anoka County, Minnesota and its <br />southeasterly extension. <br /> <br />"Line A" is described as follows: <br /> <br />Commencing at the East Quarter comer of Section 34, Township 32, Range 25, said <br />Anoka County, thence North 0 degrees 55 minutes 06 seconds West, assumed bearing, <br />along the east line of the Northeast Quarter of said Section 34 a distance of 154.98 feet to <br />intersect the southwesterly line of the Right of Way of U.S. Highways 10, 52, and 169; <br />thence North 65 degrees 24 minutes 49 seconds West, along said Right of Way a <br />distance of 772.11 feet to the actual point of beginning of "Line A" to be hereby <br />described; thence South 1 degree 05 minutes 23 seconds East to intersect the northerly <br />right of way line of 138th; thence South 65 degrees 24 minutes 49 seconds East along the <br />northerly right of way line of 138th Avenue for a distance of 4.44 feet; thence South 1 <br />degree 05 minutes 23 seconds East to intersect the northerly shore line of Mississippi <br />River and there terminate. <br /> <br />"Line B" is described as follows: <br /> <br />Commencing at the East Quarter comer of Section 34, Township 32, Range 25, said <br />Anoka County; thence North 0 degrees 55 minutes 06 seconds West, assumed bearing, <br />along the east line of the Northeast Quarter of said Section 34 a distance of 154.98 feet to <br />intersect the southwesterly line of the Right of Way of U.S. Highways 10, 52, and 169; <br />thence North 65 degrees 24 minutes 49 seconds West along said right of way a distance <br />of 657.87 feet to the actual point of designing of "Line B" to be hereby described; thence <br />South 1 degree 05 minutes 23 seconds East to intersect the northerly shore line of the <br />Mississippi River and there terminate. <br /> <br />("the Subject Property"). <br /> <br /> <br />
