Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-11-260 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0389 RELATING TO A <br />REQUEST FOR AN AMENDMENT TO THE CONDITIONAL USE PERMIT <br />ALLOWING BURY AND CARLSON, INC. TO ESTABLISH A PROCESSING <br />FACILITY FOR DEMOLITION CEMENT AND ASPHALT IN THE BUSINESS <br />WAREHOUSE DISTRICT <br /> <br />That on June 16, 1992, Bury and Carlson, Inc., hereinafter referred to as "Applicant", had <br />properly applied for a conditional use permit to establish a processing facility for demolition <br />cement and asphalt in the Business Warehouse District. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on July 23, 1992, and the <br />public hearing was properly advertised and the minutes of said public hearing were <br />incorporated into Resolution g92-08-198 adopting Findings of Fact g0318 by reference. <br /> <br />That on August 25, 1992, the Ramsey City Council adopted Resolution #92-08-199 <br />approving the issuance of a conditional use permit to the Applicant and declaring terms of <br />same. <br /> <br />That the City of Ramsey received a letter from Doherty Rumble & Butler, attorney for the <br />Applicant, dated September 20, 1995, requesting an amendment to the conditional use <br />permit to eliminate those terms restricting hours of operation and requiring weekly street <br />sweeping of Jaspar Street N.W. and 143rd Avenue N.W. west to Ramsey Blvd. N.W. <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on November 9, 1995, and that the public <br />hearing was properly advertised and that the minutes of said pubic hearing are hereby <br />incorporated into these findings by reference. <br /> <br />4. That the subject property is legally described as follows: <br /> <br />Lot 1, Block 1, Bury and Carlson Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />o <br /> <br />That the Applicant has indicated that the elimination of the restriction on hours of operation <br />is necessary to the successful operation of the facility for the following reasons: <br /> <br />a) <br /> <br />b) <br /> <br />Many roadway construction projects are done during night time hours and on <br />weekends. The Applicant needs to be able to supply these projects on a 24-hour a <br />day basis. <br /> <br />A Portion of the Applicant's property is used for snow storage in the winter. <br />Snowplowing and hauling activities also often times occur at night and on <br />weekends. <br /> <br />c) <br /> <br />The Applicant has a small retail business on the site which supplies homeowners <br />and others with decorative rock. This business needs to be open on Sundays to <br />serve its customers. <br /> <br />That no other heavy industrial uses in the area are required to regularly clean City streets <br />used to access their respective businesses. <br /> <br /> <br />
