Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-11-262 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0390 RELATING TO A <br />REQUEST FROM NORTH FORK, INC. FOR A CONDITIONAL USE PERMIT <br />TO GRADE, IMPORT AND EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a <br />conditional use permit to grade and export excess soils from the property legally described as <br />follows: <br /> <br />Part of Outlot C, NORTHFORK ADDITION, Anoka County, Minnesota. <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That on April 28, 1987, a conditional use permit was issued to L&G Rehbein, Inc. and <br />North Fork, Inc. for the grading and excavating of a lake in the Northfork P.U.D. <br /> <br />That the permit issued in 1987 had no set expiration date and subsequent to its issuance, the <br />City of Ramsey amended its grading and mining regulations. <br /> <br />That on April 23, 1991, the City of Ramey reissued the 1987 conditional use permit in <br />accordance with the revised grading and mining regulations. <br /> <br />That on August 13, 1991, the City of Ramsey approved transferring the grading and <br />mining permit from L&G Rehbeing, Inc. to Glenn Rehbein, Inc. <br /> <br />o <br /> <br />That the permit issued to Glenn Rehbein, Inc. in 1991 contained an expiration date of July <br />31, 1992. <br /> <br />That on October 26, 1995, the City of Ramey received an application from North Fork, <br />Inc., hereinafter referred to as "Applicant", for the reissuance of a conditional use permit to <br />exports soils associated with the completion of the lake excavation and revised lot grades <br />for the creation of walk-out sites. <br /> <br />That the application received on October 26, 1995, included a Grading and Drainage Plan, <br />attached hereto as Exhibit A, revised from that which was approved under the preliminary <br />plat of Northfork 5th Addition, and a Phasing & Sequencing Plan, attached hereto as <br />Exhibit B, prepared by Ulteig Engineers, Inc. dated October 17, 1995. <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on November 9, 1995, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the Subject Property is located in a golf come/residential area of a Planned Unit <br />Development and the proposed area for grading is approximately eighty (80) acres in size. <br /> <br /> <br />
