Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 95-11-263 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF <br />PERMIT TO GRADE, EXPORT AND IMPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 95-11-262 adopting <br />Findings of Fact g0390 for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On November 28, 1995, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to North Fork, Inc. ("Permit Holder") for grading, exporting and importing operations on <br />the property legally described as follows: <br /> <br />Part of Outlot C, NORTHFORK ADDITION, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire on February 28, 1999. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in <br />such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall <br />be removed from the worksite regularly. <br /> <br />All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br /> <br />4. Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />All access roads to and from the Subject Property, shall be maintained in order to minimize <br />dust. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper than <br />a rote of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face <br />be left unattended with a slope greater than 3 feet horizontal to 1 foot vertical. When <br />mining operations are anticipated to be discontinued for an interval greater than one <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br />No grading operation shall be conducted closer than 30 feet to the right of way line of any <br />existing or platted street, toad ot right of way. <br /> <br /> <br />
