10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by the City in the mount of Five Thousand Dollars ($5,000.00) shall be deposited <br />with the City. This financial guarantee may be used by the City to pay for the cost and <br />expense of repairing any public right of ways or regrading and stabilizing eroded areas due <br />to the grading operation, pay for any cost associated in administering the requirements of <br />this Chapter of the City Code, and to pay for any restoration of the worksite not properly <br />restored upon completion. <br /> <br />The Permit Holder shall implement sediment and erosion control practices. No grad/ng <br />activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the property line to prevent sediment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property line shall be regraded within forty-eight (48) hours of the precipitation event that <br />caused the erosion. <br /> <br />There shall be no stockpiling of graded materials, other than the topsoil on a temporary <br />basis, allowed within the boundaries of the Subject Property. Topsoil stockpiles shall not <br />exceed 900 cubic yards in total nor six (6) feet in height. <br /> <br />The type and placement of imported soils shall be subject to the prior approval of the City <br />Engineer. <br /> <br />The permit holder shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to <br /> one person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of <br />10 days prior notice to the City by registered mail of termination, cancellation or <br />amendment of the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this <br />item is obtained and fried with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />The permittee shall stage his operations such that no more than two (2) acres shall be <br />exposed at any single time. Restoration operations shall be coordinated to achieve this <br />goal. <br /> <br />All restoration shall consist of spreading a minimum of four (4) inches of topsoil, fertilizer, <br />seed and mulch. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall <br />be used to reimburse the City for expenses incurred in the administration of this permit. At <br />the time the mining operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br /> <br />
