19. <br /> <br />The haul route for the excavated material shall be from the site through undeveloped <br />portions of Northfork 5th and the Links golf course westerly to the railroad tracks, then <br />southerly along the railroad tracks to 153rd. No portions of paved city streets shall be used <br />except for the portion of 153rd Avenue between the railroad tracks and T.H. #10. <br /> <br />20. <br /> <br />All grading operations shall be conducted between 7:00 a.m. and 7:00 p.m. on weekdays <br />only unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />21. <br /> <br />The mount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No operation <br />shall be allowed when wind gust exceed 30 miles per hour. <br /> <br />22. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the protection <br />of water quality. <br /> <br />23. Alternative haul roads are subject to the approval of the City Engineer. <br /> <br />24. <br /> <br />While hauling operations are in progress, the permit holder shall maimain the haul road in a <br />condition satisfactory to the City Engineer. When hauling operations are completed, the <br />permit holder shall either restore that haul road to a condition at least equal to that which <br />existed at the time the hauling operations were started, or compensate the local road <br />authority in an amount satisfactory to that road authority and concurred in by the City <br />Engineer for the restoration of that haul road. The City Engineer will then accept such <br />restoration or concur in such financial settlement for the restoration of the haul road in <br />writing and such acceptance will relieve the permit holder of any additional obligation in <br />connection with the restoration of the haul roads. If the permit holder fails or refuses to <br />perform haul road restoration or to make satisfactory financial settlement for such <br />restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember Beahen <br />and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Councilmember Gerald Zimmerman <br />Councilmember Carolyn Beahen <br />Couneilmember Sheila Beyer <br />Counciimember Kenneth Peterson <br /> <br />and the following voted against the same <br /> <br />None <br /> <br />and the following abstained <br /> <br />Mayor Glen Hardin <br /> <br />and the following were absent <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the 28th day of November, 1995. <br /> <br /> <br />
