Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #96-01-030 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE PURPOSES WHEREAS, the City has initiated its public Improvement Project g95-12 (the "Improvement Project") which project consists of constructing drainage improvements in a portion of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 and part of the Southeast Quarter of the Southwest Quarter, Section 15, Township 32, Range 25, Anoka County, Minnesota; and WHEREAS, perpetual drainage easements over, under and across certain real property are required to provide for the construction of the Improvement Project and in order to further the public health, safety and convenience of the residents of the City; and WHEREAS, the City has authority to acquire the easements for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the easements prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stat. §117.011 and §117.042; and WHEREAS, certain of the necessary easements have been acquired by the City through direct negotiation with the respective parcel owners; and WHEREAS, certain additional parcels need to be acquired in order to complete the Improvement Project; and WHEREAS, the City has identified the additional parcels and the said parcel owners as follows: FEE OWNER REAL PROPERTY DESCRIPTION Robert J.
