Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-01-030 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE <br />PURPOSES <br /> <br /> WHEREAS, the City has initiated its public Improvement Project g95-12 (the <br />"Improvement Project") which project consists of constructing drainage improvements in a portion <br />of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 and part of the <br />Southeast Quarter of the Southwest Quarter, Section 15, Township 32, Range 25, Anoka County, <br />Minnesota; and <br /> <br /> WHEREAS, perpetual drainage easements over, under and across certain real property <br />are required to provide for the construction of the Improvement Project and in order to further the <br />public health, safety and convenience of the residents of the City; and <br /> <br /> WHEREAS, the City has authority to acquire the easements for the Public Improvement <br />by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the easements prior to the filing of an award <br />by the Court appointed commissioners, pursuant to Minn. Stat. §117.011 and §117.042; and <br /> <br /> WHEREAS, certain of the necessary easements have been acquired by the City through <br />direct negotiation with the respective parcel owners; and <br /> <br /> WHEREAS, certain additional parcels need to be acquired in order to complete the <br />Improvement Project; and <br /> <br /> WHEREAS, the City has identified the additional parcels and the said parcel owners as <br />follows: <br /> <br />FEE OWNER <br /> <br />REAL PROPERTY DESCRIPTION <br /> <br />Robert J.
