NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the easements as described above <br />in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate <br />and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the easements as described above cannot be acquired by direct negotiation on or <br />before February 15, 1996, they shall be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Council hereby authorizes acquisition of the said easements by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />4) <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to prosecute <br />such action to a successful conclusion or until it is abandoned, dismissed or terminated by <br />the City or Court. <br /> <br />5) <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisals of the <br />damages to the owners of the Property as a result of the takings herein. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Hardin <br />Councilmember Zimmerman <br />Councilmember Beahen <br />Councilmember Beyer <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br /> <br />the 23rd day of January, 1996. <br /> <br /> ATTE)~~ <br />· t~~dministrator ' <br /> <br />RESOLUTION <br /> <br />~Mayor <br /> <br />#96-01-030 <br /> <br />Page 2 of 2 <br /> <br /> <br />
