concave to the Northwest; with said curve having a radius of 425.00 feet a central <br />angle of 35 degrees 51 minutes 25 seconds, a chord length of 261.66 feet (chord <br />bears South 46 degrees 27 minutes 41 seconds Wes0 for an arc length of 265.97 <br />feet to a point of tangency; South 64 degrees 23 minutes 23 seconds West a <br />distance of 63.65 feet to the POINT OF BEGINNING herein containing 13.7705 <br />acres of land area <br /> <br />That the proposed plat lies within the shoreland overlay district for Grass (Sunfish) <br />Lake (Protected Water #2-113). <br /> <br />That Section 9.21.04 of the Ramsey City Code establishes a minimum lot size of <br />20,000 square feet for riparian lots and 15,000 square feet for non-riparian within <br />the sewered area of the subject overlay district. <br /> <br />That the Applicant's plat proposes to create 25 single family urban residential lots <br />within the 12 acre area, ten (10) of which are considered riparian and fifteen (15) of <br />which are considered non-riparian. <br /> <br />That the Applicant has stated that the minimum lot sizes in the overlay district create <br />a hardship because of the marginal depth of developable property between the lake <br />and Sunwood Drive, and the need for the lots within the plat to be served by a <br />minor street off of Sunwood Drive. <br /> <br />That the Applicant has stated that the marginal depth of developable property <br />between the lake and Sunwood Drive is due, in part, to the fact that the alignment <br />for Sunwood Drive has been relocated nearer the lake than origianlly proposed or <br />planned. <br /> <br />That the Applicant has designed the plat in such a manner that the ten (10) riparian <br />lots meet the 20,000 square foot area requirement. <br /> <br />That the Applicant's plat proposal is designed in such a manner that only four (4) of <br />the fifteen (15) non-riparian lots meet the 15,000 square foot area requirement. <br /> <br />10. <br /> <br />That the plat proposes an average lot size of 13,822 square feet for non-riparian lots <br />and 21,756 square feet for riparian lots, for a total of 424,890 square feet absorbed <br />by 25 lots. Under Section 9.21.04 of the Ramsey City Code, 25 lots meeting the <br />15,000 and 20,000 square foot area requirements would absorb 425,000 square <br />feet of property. Therefore, the Applicant's proposal does not increase the number <br />of lots that would have been allowed had the area requirements been complied with <br />on a lot by lot basis. <br /> <br />11. <br /> <br />That the intent of the development standards in the overlay district are to preserve <br />and protect public waters from pollution. <br /> <br />12. <br /> <br />That the subject plat will be served by a municipal water system and the existing on- <br />site septic system for the riparian homestead will be converted to the municipal <br />system. <br /> <br />13. That the subject plat will be served by a storm sewer system. <br /> <br />14. <br /> <br />That the special conditions causing the hardship, namely the depth of the subject <br />property lying between the lake and the collector street, do not result from the <br />actions of the Applicant. <br /> <br /> <br />
