10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />That the City is currently in the process of updating the land use element of the <br />Comprehensive Plan and the subject property is proposed to be designated for development <br />with mixed residential uses with commercial uses being retained adjacent to C.S.A.H. #56. <br /> <br />That the rezoning application was submitted to City Council on lanuary 23, 1996 and the <br />Council adopted Resolution g96-01-027 adopting findings of fact relating to the rezoning <br />request and introduced an ordinance to rezone the subject property. <br /> <br />That on January 23, 1996, City Council requested that certain additional information be <br />provided when the ordinance was brought back to City Council for adoption. <br /> <br />That on February 13, 1996, City Staff presented City Council with the requested <br />information and the Applicant presented City Council with a revision to the proposed <br />rezoning request that would reduce the amount of area to be rezoned to residential, legally <br />described as follows, and thereby retain some industrial zoning adjacent to C.S.A.H. #56: <br /> <br />The North Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka <br />County, Minnesota, also including that part of the Southeast Quarter of the Northwest <br />Quarter lying northeasterly of Anoka County Highway Right of Way plat No. 8. Except <br />that portion of said North Half described as follows: <br /> <br />That part of the West 350 feet of the Northwest Quarter of the Northwest Quarter of <br />Section 27, Township 32, Range 25, Anoka County, Minnesota: Commencing at a cast <br />iron monument found for the Northwest comer of said Section 27, thence South 00 <br />degrees 33 minutes 47 seconds East, an assumed bearing, with the West line of said <br />Section 27, a distance of 351.90 feet; Thence North 89 degrees 26 minutes 13 seconds East <br />a distance of 60.00 feet to the POINT OF BEGINNING herein; Thence continuing North <br />89 degrees 26 minutes 13 seconds East, a distance of 64.03 feet to a point of curvature of a <br />curve concave to the Southwest; Thence with said curve having a radius of 130.00 feet, a <br />central angle of 45 degrees 42 minutes 51 seconds, a chord length of 100.99 feet (chord <br />bears South 67 degrees 42 minutes 22 seconds East) for an arc length of 103.72 feet to a <br />point of tangency; Thence South 44 degrees 50 minutes 56 seconds East, a distance of <br />47.18 feet to a point of curvature of a curve concave to the Northeast; Thence with said <br />curve having a radius of 70.00 feet, a central angle of 45 degrees 42 minutes 51 seconds, a <br />chord length of 54.38 feet (chord bears South 67 degrees 42 minutes 22 seconds East) for <br />an arc length of 55.85 feet to a point of tangency; Thence North 89 degrees 26 minutes 13 <br />seconds East, a distance of 49.85 feet; Thence South 00 degrees 33 minutes 47 seconds <br />East, a distance of 879.24 feet to the North right of way line of County Road 116; Thence <br />continuing with said right of way South 89 degrees 26 minutes 45 seconds West, a <br />distance of 300.00 feet to the intersection of said right of way and the East right of way line <br />of County Road 56; Thence continuing with said East right of way North 00 degrees 33 <br />minutes 47 seconds West, a distance of 418.00 feet; Thence North 89 degrees 26 minutes <br />45 seconds East, a distance of 10.00 feet; Thence North 00 degrees 33 minutes 47 seconds <br />West a distance of 555.32 feet to the POINT OF BEGINNING. <br /> <br />That on February 13, 1996, City Council was receptive to the proposed revision to the <br />rezoning configuration and directed that the modification be presented to the Planning <br />Commission. <br /> <br />That on March 4, 1996, the Planning Commission conducted a public heating regarding the <br />revision to the rezoning request to reduce the amount of property to rezoned to residential <br />and recommended City Council approval of the request. <br /> <br /> <br />
