Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g96-04-065 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT //0396 RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, William J. Schrader, hereinafter referred to as "Applicant", has properly <br />applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an accessory <br />garage nearer the front property line than the principal structure on the property generally known as <br />16750 Wolverine Circle N.W. and legally described as follows: <br /> <br />Lot 7, Block 4, Hunters Ridge, Anoka County, Minnesota. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of <br />the Ramsey City Code on April 2, 1996 and that said public hearing was properly <br />advertised and that the minutes of said public heating are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned Planned Unit Development and is approximately 1.3 <br />acres in size. <br /> <br />That the subject property is surrounded by Planned Unit Development zoning developed <br />with single family homes. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located approximately 150 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 98 feet <br />from the front property line. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, the location of septic system on the garage <br />side of the dwelling, mature tree growth over the entire parcel, and sharp declines in <br />topogrphy in the side and rear yards. <br /> <br />That the special condition causing the undue hardship (a 150 foot accessory structure <br />setback based on the dwelling location) was caused by the siting of the home on the lot; <br />however, the house location is the only reasonable building site on the lot due to sharp <br />delcines in topography and heavy tree growth. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />10. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />11. <br /> <br />That the Applicant has stated that such variance is necessary for the preservation of a <br />substantial property right similar to that possessed by other properties in the R-1 <br />Residential District. <br /> <br /> <br />
