Board Member Holland introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-05-124 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0400 RELATING TO A <br />REQUEST FOR A VARIANCE FROM STREET FRONTAGE OR LOT WIDTH <br /> REQUIREMENTS <br /> <br /> WHEREAS, Jacob Barthold, hereinafter referred to as "Applicant", has properly applied <br />for a Board of Adjustment variance from the minimum lot width requirement established in Section <br />9.20.11 of the Ramsey City Code in order to construct a dwelling on the following legally <br />described property: <br /> <br />The Southwest Quarter of the Southeast Quarter of Section 14, Township 32, Range 25, <br />Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public heating pursuant <br />to Section 9.03.05 of the Ramsey City Code on May 7, 1996 and that said public heating <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the Subject Property is zoned R-1 Urban Residential and is approximately 40 acres in <br />size. <br /> <br />That the Subject Property is bounded on the north, south and west by property that is <br />zoned R-1 Rural Residential and the property to the east is zoned R-1 Urban Residential. <br /> <br />That the Subject Property is within the Metropolitan Urban Service Area but sanitary sewer <br />and municipal water are not available to the site. <br /> <br />That Section 9.11.01 of the Ramsey City Code states that no lot shall contain any building <br />used as a dwelling unless it has the minimum lot width; Section 9.20.12 states that the <br />minimum lot width for a lot without sanitary sewer in the Urban Residential District is 200 <br />feet. <br /> <br />That the Subject Property has approximately 132 feet of frontage on public roads, 157th <br />Lane N.W. and 158th Lane N.W. <br /> <br />7. That the City has previously granted similar variances. <br /> <br />8. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />That the City Public Works Department has indicated that the terminus of 157th Lane N.W. <br />at the west boundary of the subject property is a substandard, temporary cul-de-sac in need <br />of improvements. <br /> <br />10. <br /> <br />That the special conditions, 132 feet of frontage on public roads, do not result from the <br />actions of the Applicant. <br /> <br />11. <br /> <br />That the granting of the variance will not grant the Applicant any special privileges that are <br />denied by this Chapter to other owners of land in the same district. <br /> <br /> <br />
