Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION#96-05- <br /> A RESOLUTION ADOPTING FINDINGS OF FACT# RELATING TO A <br /> REQUEST FOR A CONDITIONAL USE PERMIT FOR A GROUP FOSTER <br /> HOME. <br /> WHEREAS, on February 7, 1995, Patrick J. McLafferty, hereinafter referred to as <br /> "Applicant", applied for a Conditional Use Permit for a Group Foster Home on the <br /> property , <br /> generally known as 7321 154th Lane N.W. and legally described as follows: <br /> The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the <br /> Southeast Quarter of the Northeast Quarter of Section 21,Township 32, Range 25 in <br /> Anoka County,Minnesota; said distances being measured parallel with the East and North <br /> lines of said Southeast Quarter of the Northeast Quarter, subject to an easement for road <br /> purposes over the South 33 feet thereof; and <br /> WHEREAS, on April 25, 1995, the Ramsey City Council adopted Resolution #95- <br /> 04-076 declaring Findings of Fact #0375 and denied the application for a conditional use <br /> permit; and <br /> WHEREAS, the Applicant appealed the City's denial of the <br /> conditional use permit to the District Court; and <br /> WHEREAS, the Anoka County District Court, as a result of the <br /> Applicant's appeal, ordered the City to conduct a second public hearing and <br /> reconsider the request for a conditional use permit specifically using City <br /> Code conditional use permit criteria. <br /> NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1 . That on March 15, 1996, the District Court, Anoka County, <br /> Minnesota, issued an order directing the City to reconsider the <br /> Applicant's application for a conditional use permit and, in arriving <br /> at a decision to grant or deny such application, shall make <br /> appropriate and detailed findings regarding the basis for its decision <br /> as prescribed by Ramsey Zoning Ordinance, Section 9.03.04. <br /> 2. That the Applicant appeared before the Planning and Zoning Commission for a <br /> second public hearing pursuant to Section 9.03.04 (Conditional Use Permits) of the <br /> Ramsey City Code on May 7, 1996. During the public hearing, the Applicant left <br /> the Council Chambers while the hearing was in progress, and returned to the <br /> Council Chambers prior to public hearing adjournment. The public hearing was <br /> properly advertised and the minutes of said public hearing are hereby incorporated <br /> as a part of these findings by reference. <br /> 3. That the subject property is approximately one acre in size. <br /> 4. That the subject property is zoned R-1 Rural Residential and is not served by ' <br /> sanitary sewer and municipal water. <br /> i <br /> -7q <br />
