' 5. That the City is directed by State Statute 462.357 (Subd. 7 and 8) with regard to permitting state licensed residential facilities. ' 5.A That State Statute 462.357, Subd. 7, directs that a residential facility serving six or fewer persons is a permitted single family residential use of property. 5.B That State Statute 462.357, Subd. 8, permits the City to require a conditional use permit for any residential facility serving more than ' six persons. 6. That the Applicant has applied for a conditional use permit to operate a foster home in the single family district that will accommodate up to eight(8)youth. ' 7 . That-the subject property is adjacent to R-1 Rural Residential zoning on all sides. ' 8. That the Applicant and his spouse reside in the home as the foster parents. 9. That the Applicant is required to be licensed through the State, County, and sponsoring agency. 10. That as a part of the licensing procedure, the foster home is initially and regularly ' thereafter inspected for compliance with State and County criteria and standards (physical, social and environmental) for such facilities. 11. That as part of the State licensing procedure, Anoka County was directed to review the on-site septic system on the Subject Property and has given its approval of same. ' 12. That the Applicant has previously operated a group foster home in the City of Shoreview. 13. That the Shoreview Police Department has indicated to Ramsey City Staff that from May of 1993 to May of 1994, their department received 15 calls to the Applicant's residence; 14 were classified as domestics and one was a noise nuisance. 14. That the Ramsey Police Department has indicated that from 1/20/95 to 1/8/96 there have been 5 domestics, 2 assaults, 4 damage to property,5 runaway, 2 false alarm, 1 dog, 1 outdoor fire, 1 illness, and 1 offender registration incident reports generated from the subject property. 15. That the addition of two youth at the residence will not be unduly dangerous or otherwise detrimental to neighboring residences. 16. That the addition of two youth at the residence will not substantially adversely impair the use, enjoyment or market value of any surrounding property. 17. That the addition of two youth at the residence will be operated and maintained so as to-be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and the addition of two youth at the residence will change the essential character of the area. �s t
