Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-06-137, A RESOLUTION ADOPTING FINDINGS OF <br />FACT #0402 RELATING TO A REQUEST FOR A VARIANCE TO THE <br />IMPERVIOUS SURFACE AREA REQUIREMENTS IN THE MISSISSIPPI <br />CRITICAL RIVER CORRIDOR <br /> <br /> WHEREAS, L.A.N.D. Properties, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Board of Adjustment variance from Section 9.21.07 (Critical <br />River Overlay District Development Standards) of the Ramsey City Code to develop a <br />parcel with a 77% impervious surface area on the property legally described as follows: <br /> <br />Lot 1, Block 1, RIVERSIDE WEST, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE <br />OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of AdjusUnent for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on June 4, 1996 and that said <br />public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated as a part of these findings by reference. <br /> <br />That the subject property is zoned B-3 Highway Business and is approximately 5 <br />acres in size. <br /> <br />That the Subject Property is located in the Mississippi Critical River Overlay <br />District. <br /> <br />That the property to the north, west and east is zoned B-3 Highway Business, and <br />the property to the south is zoned R-1 Urban Residential. <br /> <br />That the Applicant is proposing to develop a retail center on the subject property <br /> <br />That Section 9.21.07 (Critical River Overlay District Development Standards) of the <br />Ramsey City Code restricts the impervious surface area to 30% of the lot in order to <br />maintain the water quality and prevent pollution of the Mississippi River and <br />preserve the natural aesthetic value of the corridor. <br /> <br />That the Subject Property is' not visible from the Mississippi River and the <br />Applicant has proposed a drainage plan that appears to meet the minimum water <br />quality requirements of the Lower Rum River Water Management Organization. <br /> <br />That similar variances have been granted to properties in the Mississippi Critical <br />River Overlay District that were certified by DNR. <br /> <br />That the Applicants request for a variance to the impervious surface area has been <br />forwarded to the Department of Natural Resources. <br /> <br /> <br />
