Namely: a) the subject property <br />is in the Critical Overlay District and lot development is restricted to 30% of the lot <br />area; b) Other parcels in the Overlay District were allowed to be developed beyond <br />the 30% impervious surface area limit through variances granted; c) City Code <br />requires that all off-street parking, driveways and maneuvering areas be paved and <br />curbed in the Business district. <br /> <br />That the proposed Coverage of the lot by buildings is approximately 17%, which is <br />in accordance with the 35% lot coverage restrictions for the B-3 Highway Business <br />District. <br /> <br />That the Subject Property cannot be put to a reasonable use under, the 30% <br />impervious surface area restriction considering its present commercial zoning and <br />valuation. <br /> <br />That the special conditions causing the undue hardship, inclusion of the property in <br />the Critical River Overlay District, do not result from the actions of the Applicant. <br /> <br />That such variance is necessary for the preservation of a substantial property <br />right similar to that possessed by other properties in the B-3 Highway Business <br />District. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege <br />that is denied to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the B-3 Highway Business District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially <br />impair property values within the neighborhood. <br /> <br />That a letter dated June 4, 1996 from Robert Collett of the Department of Natural <br />Resources was received at the City with obvious discrepancies in runoff and <br />ponding capacity calculations that need to be corrected accordingly. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member Thomd and upon vote being taken thereon, the following voted in favor thereof.' <br /> <br />Chairperson Benjamin Deemer <br />Board Member Michael Terry <br />Board Member Bradley Thorud <br />Board Member David Bawden <br />Board Member Charles LaDue <br />Board Member Paul Holland <br />Board Member Sharon Jensen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
