Councilmember Peterson introduced the following resolution and moyed for its adoption: <br /> <br /> RESOLUTION #96-06-146 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT gO~03 RELATING TO A <br />REQUEST FROM EDSON INVESTMENT LIMITED pARTNERSHIP FOR A <br />CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS <br /> WHEREAS, the City of Ramsey received an application from Edson Investment Limited <br />Partnership for a conditional use permit to grade and export excess soils from the property legally <br />described as follows: <br /> <br />BRANDSETH, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CIT~Y COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF !MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />1. That on June 4, 1996, Edson Investment Limited Partnership, hereinafter referred to as <br /> "Applicant", properly apphed for a condiuonal use perrmt to grade and export excess soils <br /> from the plat of Brandseth, which plat received final plat approval from the City Council <br /> on March 26, 1996. <br /> <br /> That the applicant appeared before the Ramsey Planning Co .mmission for a public hearing <br /> pursuant to Section 9.03.04 of the City Code on June 4, 1996~ and that said public hearing <br /> was properly advertised and that the minutes of said public hearing are hereby incorporated <br /> as a part of these findings by reference. <br /> <br /> That in conjunction with final plat approval on March 26, 199~6, the Ramsey City Council <br /> approved the Grading Plan for Brandseth prepared by Hakanson Anderson Associates, <br /> Inc., dated December 20, 1995, subject to the City Staff Revie~v Letter March 19, 1996. <br /> <br /> That the Applicant is proposing to export approximately 211000 yards of earth material <br /> from the Subject Property. <br /> <br /> That the Applicant has stated that the proposed haul route for iricoming and outgoing tracks <br /> will be from an access point on 153rd Avenue N.W. from Outlot A, Brandseth. <br /> <br /> That no fill materials are proposed to be imported to the site. <br /> <br /> That no blasting will be employed in the grading activity. <br /> <br /> That the existing drainage patterns will not be substantially altered by the proposed grading <br /> plan. <br /> <br /> That the grading operation will increase the traffic to and from the subject property for a <br /> one year time frame. <br /> <br /> That the proposed use will not be unduly dangerous or other~Vise detrimental to persons <br /> residing or working in the vicinity of the use or to the public welfare. <br /> <br />o <br /> <br />6 <br /> <br />7. <br /> <br />8. <br /> <br />o <br /> <br />10. <br /> <br /> <br />
