feet in width lying South and immediately <br />adjacent to line A, hereinafter described and <br />laying East of line B, hereinafter described: <br /> <br />Line A: Beginning at a point on the East line of <br />said Lot 1 distant 462.68 feet South of the <br />Northeast comer thereof; thence West parallel <br />with the North line of said Lot 1 to a point of <br />intersection with line B. <br /> <br />LINE B: A line which is parallel to the East <br />line of said Lot 1 and distant 380 feet West of <br />said East line of Lot 1, as measured along a <br />line which bears North 67 degrees 47 minutes <br />West from the East line of said LOt 1. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the fee title to real property as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it shall <br />be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Council hereby authorizes acquisition of the said mai property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes §117.011 and §117.042. <br /> <br />4) <br /> <br />That the City Attorney is authorized to file the necessary petition, therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br /> <br />5) <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisals of the <br />above described real property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen and upon vote being taken thereon, the following voted in favor thereofi <br /> <br />Mayor Hardin <br />Councilmember Peterson <br />Councilmember Beahen <br /> <br />and the following voted against the same: <br /> <br />Councilmember Beyer <br />Councilmember Zimmerman <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION #96-08-188 <br /> Page 2 of 3 <br /> <br /> <br />
