Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-09-214 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT #0410 RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Stephen Schmidt, hereinafter referred to as "Applicant", has properly <br />applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an accessory <br />garage nearer the front property.line than the principal structure on the property generally known as <br />8360 176th Avenue N.W. and legally described as follows: <br /> <br />Lot 11, Block 1, Wildwood Acres, Anoka County, Minnesota. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of <br />the Ramsey City Code on September 3, 1996 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject prOperty is zoned R-1 Rural Residential and is approximately 2.7 acres in <br />size.. <br /> <br />o <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning developed with <br />single family homes. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />o <br /> <br />That the principal structure on the subject property is located approximately 120 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 85 feet <br />from the front property line. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely that the side and rear yards contain mature <br />tree growth, sharp declines in topogrphy and wetlands. <br /> <br />o <br /> <br />That the special condition causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />10. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />11. <br /> <br />That the Applicant has stated that such variance is necessary for the preservation of a <br />substantial property right similar to that possessed by other properties in the R-1 <br />Residential District. <br /> <br />12. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br /> <br />
