Councilmember Bcahen moved for the adoption of the following findings of fact: RESOLUTION #96-09-271 A RESOLUTION ADOPTING FINDINGS OF FACT #0412 RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT FOR A PERSONAL COMMUNICATION SERVICE (PCS) TOWER WHEREAS, American Portable Telecom (APT), hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit to construct, install and operate a telecommunications site on the property legally described as follows: Lot 1, Block 1, HY-10 RAMSEY, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on September 3, 1996 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. That the Subject Property is located in the Industrial District, is approximately 4.3 acres in size, and is owned by KRH Land, LLC. That the Applicant is proposing to lease a 50' x 50' section of the Subject Property (site) to facilitate the development of the tower. 4. That the surrounding parcels are also zoned Industrial. .8. That the Applicant is proposing to place a 165 foot self-supporting lattice telecommunication tower and equipment cabinets on the site, all of which will be encompassed by an 8 foot high chain link fence topped with 3 strands of barbed wire. That the Applicant has submitted support documents to the application consisting of a letter from A. Keith Dyer, Property Specialist for APT, dated August 12, 1996 and a site plan consisting of Sheets T1 (Project Information), A1 (Site Plan), A2 (Enlarged Plan), A3 (North and South Elevations), and A4 (East and West Elevations), prepared by Fluor Daniel, Inc. and dated August 8, 1996. That the Applicant has stated that because the PCS uses low power to insure that the signal stays within the designated cell, it will not interfere with neighboring cells and no ionizing radiation is created. That the Applicant has stated that the Ramsey cell site would establish service for the Ramsey area and Hwy. 10 between Anoka and Elk River and other proposed sites cannot provide coverage to the City of Ramsey due to distance and topographic constraints. 9. That there will be no personnel stationed at the site.
