Board Member Bawden introduced the following resolution and moved for its adoption:

RESOLUTION 6'96-11-316

A RESOLUTION ADOPTING FINDINGS OF FACT g0413 RELATING TO A
REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE
NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE

WHEREAS, James and Michele Myslicki, hereinafter referred to as "Applicants", have
properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an
accessory garage nearer the front property line than the principal structure on the property generally
known as 16811 Zirconium Street N.W. and legally described as follows:

The North Half of the South Half of the East Half of the Northeast Quarter of the Southeast
Quarter of Section 10, Township 32, Range 25, Anoka County, Minnesota; subject to the
road easement over the west 33 feet thereof.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF
ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF
MINNESOTA, as follows:

That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of
the Ramsey City Code on November 7, 1996 and that said public hearing was properly
advertised and that the minutes of said public hearing are hereby incorporated as a part of
these findings by reference.

4

That the subject property is zoned R-1 Rural Residential and is approximately 5 acres in
size.

o

That the subject property is surrounded by R-1 Rural Residential zoning developed with
single family homes.

That Section 9.11.02 of the Ramsey City Code does not permit the construction of
accessory structures nearer the front property line than the principal structure.

o

That the principal structure on the subject property is located approximately 154 feet from
the front property line.

That the Applicant is proposing to construct an accessory garage approximately 95 feet
from the front property line.

That there are unique circumstances applying to the subject property that do not generally
apply to other properties in the district; namely sharp declines in topography in the side and
rear yards in conjunction with mature tree growth and the location of the septic system.
That the special conditions causing the undue hardship do not result from the actions of the
Applicant.

That similar variances have been granted in the R-1 Rural Residential district in the City of
Ramsey.

10. That the variance requested is the minimum variance which would alleviate the hardship.

11.

That the Applicant has stated that such variance is necessary for the preservation of a
substantial property right similar to that possessed by other properties in the R-1
Residential District.
